Would Scott Guthrie's case count as fraud?

In NZ there is this guy called Scott Guthrie...

From the information given in the news article, probably not. Just a guy with careless business practices who's constantly screwing up with other people's money then moving on. Nothing, at least at the moment, indicating fraud.

Might be worth keeping an eye on. If he gets himself into a tight situation, he might start adopting some sovcit technique.
