I realize that there are always exceptions, but remember Babe Ruth started his career as a pitcher.

I'm not a fan of baseball, but one of my favorite authors, evolutionist/snail expert Stephen J Gould, definitely was. He sometimes used baseball analogies in his columns.

I was kind of surprised by the section of the opinion on res judicata, because I thought Judge Buch would point out that res judicata (and collateral estoppel) worked *against* Hendrickson, and not for him, because they helped establish fraudulent intent for the purpose of the penalties.

But the judge didn't. And I guess that's why he's a judge and I'm not.

Because the U.S. Tax Court decision against Peter and Doreen Hendrickson was entered on February 11, 2019, the deadline for Pete to file a notice of appeal would appear to be May 12 (90 days after the date of entry of the decision, under IRC section 7483 and Rule 13 of the Federal Rules of Appellate Procedure). So far, I see nothing.

Pete Hendrickson - Savior of the Rule of Law? Or Snake Oil Salesman? YOU be the judge!

Here is bit of his sales pitch, from his web site:

http://losthorizons.com/N/41.htm#Remedy
Revelations Are The Singular Remedy To The Out-Of-Control State

Look at the facts and you'll have to agree...

THAT TITLE TO THIS ARTICLE seems pretty pretentious, doesn't it? But still, let's look at it.

CtC reveals the Constitutional and statutory design of the income tax.
As that design exists only in Pete’s mind, and in the minds of his marks (oops, I mean, in the minds of his “CtC Warriors”).....
That design provides for unilateral control by individual Americans over the amount of wealth available to the state for its maintenance and growth, which inexorably results in the shrinkage and rigid confinement of the state to a lean and proper attention to only its Constitutionally-mandated responsibilities.
But the shrinkage doesn't stop there! Pete is too modest to mention that the regular use of CtC will also reduce your weight, clean up your complexion, and make you more attractive to members of the opposite sex!
CtC's revelations have also resulted in the exposure of a well-rooted institutional corruption (see here [link not reproduced] and here [link not reproduced], for instance) which is bent on shielding the Leviathan disease from what it fully understands to be its unwelcome cure.
CtC also prevents bad breath! It also makes a great cooking oil!
In light of these factors, it can be seen that unlike any other approach to shrinking the swollen and recalcitrant state, CtC's revelations:
Just rub CtC right on your sore joints, folks, and watch the magic -- as both the swelling AND the recalcitrance quickly recede!
•invoke every single productive American's personal interests in his or her own well-being, prompting actions in support of that interest which have the inescapable side effect of shrinking the state;
More shrinking!
•invoke every single American's love and respect for the rule of law and the intent and sacrifices of the Founders in support of his or her state-shrinking actions; and
Shrinking, shrinking, shrinking, shrinking, shrinking, shrinking, shrinking, shrinking, shrinking, shrinking......
•invoke every single American's disdain for political and institutional corruption in support of his or her state-shrinking actions.
I think the key word here is “shrinking.”

This CtC stuff is just amazing. Use it, and your disdain for corruption will be MORE than offset by your “dain” for CtC!
FURTHER, THE REMEDY PROVIDED by CtC's revelations:

•is uniquely invulnerable to the manipulations and erosions of the political process which are routinely brought to bear against all other remedies to the metastasizing state;
CtC does not require refrigeration after opening, either!
•is uniquely invulnerable to ideology-- even the most ardent socialist will act vigorously to reduce his or her tax burden to the maximum extent possible under the law; and
Excuse me, while I vigorously rub a little more of this CtC on my joints. Ooooooooooh, it's better than sex!
•is uniquely and long-since thoroughly proven to furnish Americans with enormous prosperity and at the same time a fully-functional but minimally-harmful state apparatus truly-focused on its real mission: securing the rights of all Americans.
Using the same methods of “proof,” CtC has been found to cure the male impotence of many of the most ardent tax protesters (oops, I mean the most ardent “CtC Warriors)!
SO, POP THE CORK ON SOME CHAMPAGNE, PEOPLE! The restoration of the Republic is absolutely on the table.

All that is needed-- and the only thing that will actually do the job-- is to spread CtC's revelations!!

***

P.S. Please understand, my friends: I'm counting on you to help everyone you know-- especially those troubled by ANY KIND of bad behavior by the state-- come to understand the argument I have just presented. It is way past time that concerned Americans get out of the sand of false hopes in which they are merely spinning their wheels, and form up behind the one real solution.
SPREAD THE WORD!!
Just don't spread the word about CtC's 100% failure rate in Federal court.

:P

EDITED: To correct a typo on the spelling of the word "vigorously".

Its kind of counter message to point out shrinkage in an ad that also brags about helping erectile dysfunction. Just sayin'

Yeah, but repetitive inconsistency in logic is consistent with Blowhard Hendrickson's treatment of CtC court defeats as VICTORIES!

CtC also cures iron deficiency anemia, the heartbreak of psoriasis, halitosis, and neuritis/neuralgia, and tells Peter Pain to take a walk.

Has anyone been stupid lucky enough to have what they would call a win to post on the Hapless Henrickson's wall of FAIL yet? I guess maybe it is early days yet after those heady days of yore when they thought they were all coming up roses and snozzberries until they weren't. I guess their one consolation could be that the IRS maybe tightened up their refund criteria a bit after their "successes".

Last Friday, the IRS submitted its computations for the Rule 155 computation of the deficiency amount in Pete and Doreen's case, and, on Monday, the Hendricksons submitted theirs:
05/10/2019 COMPUTATION FOR ENTRY OF DECISION by Resp.

05/13/2019 COMPUTATION FOR ENTRY OF DECISION by Petrs. Peter E. Hendrickson & Doreen M. Hendrickson (ATTACHMENTS)
The Tax Court will likely enter a decision in the near future. The Hendricksons will then have 90 days to Appeal. Notably, collection is not stayed during any appeal.

Oops. Rule 155. I hadn't noticed.

Lemme guess, the IRS says eleventy million dollars and Pete says "nada, cause I don't wanna".
Surely this guy is due to do something stupid enough to send him back to prison soon.
