Apparently Snipes is filming in Vancouver. Bernhoft yesterday flled a request that Snipes be permitted to attend the conference concerning his application to postpone the trial by telephone, citing inconvenience and potential for a "media circus". I'm sure that the latter would absolutely devastate Bernhoft.

Judge Hodges' one-word response: "Denied".

Anybody in Ocala on Tuesday? This should be fun.

Something else just occurred to me (beats working, right?). Snipes has known Bernhoft for years - Bernhoft represented him in a paternity suit which got some press several years ago. Snipes just decided, on the eve of trial, that he wants Bernhoft to represent him?

If Judge Hodges doesn't already know this, I somehow think the govt will inform him.

No offense, but are we talking about the Billy Martin that completely fooked Michael Vick, stated in a press release that Larry Craig's effort to withdraw his guilty plea "should be nearly impossible" while his motion to do exactly that was pending (and was later denied), and most recently called Snipes' effort to replace him a "ploy to get a continuance" notwithstanding the fact that the Judge lambasted him for having no clue as to deadlines, or the information in the discovery he had long ago received? Attorneys are not supposed to put their own ego over the best interests of their clients.

This is a tax case - Bernhoft won for Kuglin and Banister - what tax case has Martin ever won?

As far as I am concerned, Meachum and Martin epitomize affinity fraud.

Of course Judge WTH knows this - Bernhoft represented Snipes during the pre-indictment phase of this case.

Not that I know of. Martin said something similar to the Court during the hearing, by way of acknowledging what can't be denied - the paucity of success such motions encounter. I probably would have done exactly the same.

I didn't know that. PACER doesn't show it, Martin represented him from arraignment on, and I don't have the benefit of being from the Middle District of Florida.

So Bernhoft enters the case, and immediately files a raft of motions which can only be described as pro forma. They're not frivolous, since (of course) the govt really does have Brady and Giglio obligations. However, these are the kind of motions which allow a lawyer who is so inclined to boast to the client about how much he is doing, and which really accomplish nothing.

For those who don't have PACER access, that last docket entry - the order denying in two pages hundreds of pages of motions - is here. Hodges denies every motion without explanation, except to direct the govt to turn over Snipes' own statements - something the govt probably did months ago. The last sentence is Hodges' way of telling Bernhoft that he don' need no steenkin' reply.

ORLANDO, Fla. - Lawyers for Wesley Snipes argued the actor's tax-evasion trial should be moved to Orlando or New York because he cannot get a fair trial in Ocala.

Snipes previously filed two motions to dismiss or transfer the trial because of racial prejudices in Ocala. Lawyers say Snipes has the right to a trial in New York. He lived there between October 2000 and April 2005 when the alleged offenses occurred. He also has a home in Orlando.

Snipes' attorneys also asked to delay the start of trial from January to April.

U.S. District Judge William Terrell Hodges didn't rule on either request. He says he will issue written rulings in the coming days.

Federal prosecutors have previously said Snipes' claims he cannot get a fair trial because of racial prejudice in the area are not based on fact.

An October 2006 federal indictment charges Snipes with fraudulently claiming refunds totaling almost $12 million in 1996 and 1997 for income taxes already paid.

By order dated December 24 - Merry Christmas! - all of Snipes' motions were effectively denied. I say "effectively" because (for example) Snipes made a motion to preclude a govt expert from testifying that the only use for his "bills of exchange" was to commit fraud, which motion was granted on the consent of the govt. However, that expert will still be able to testify about what a "bill of exchange" is - or, more accurately, is not.

Specifically, Snipes' motion to change venue to Manhattan was denied, the Court quite correctly saying that a comparison of the racial composition of one district versus another is irrelevant, and also noting that
As the Court has previously made abundantly clear, (see Doc. 188, pp. 13-21), there are no compelling reasons to transfer this case to another venue, particularly where the case involves two co-conspirators with strong ties to Florida, and where the question of Defendant Snipes place of residence during the relevant time period remains a fact question very much in dispute.
Snipes is really not gonna like sitting next to Fast Eddie Kahn.

BTW, Kahn's wackadoodle pro se motions - including one to recuse Judge Hodges for "impersonating a federal judicial officer" - were also all denied. Finally, the joint motion to continue the trial was denied. January 14, folks.

Uh-oh. That goes to the issue of willfulness (voluntary intentional violation of a known legal duty). Of course, the typical tax protester response here should be something like: "Uh, well, yeah, I guess the Feds did me I was under criminal investigation, but, but, but -- they didn't use just the right magic words."

Let me get this straight - an investigation has gone on for at least five or six years involving a famous actor, millions of dollars in taxes due going back nearly ten years now, and to top it off a known tax protester is also involved.

Am I the only one that sees something wrong with this picture?

Snipes' counsel thinks he can't get a fair trail based on race; I submit he's been given far too much consideration already, and they should be more concerned about the typical taxpayer who's had a run-in with the IRS who is wondering why they let him get away with it this long.

Far be it for me to predict the outcome of this trial, but how many folks here besides myself think Snipes is totally hosed?

He's definitely financially hosed. If he's convicted, sentencing will probably include consideration for his ability to continue to generate substantial earnings from which to pay the back taxes, penalties and interest. Then again, I would also suspect that a some portion of his wealth is out of reach.

What should be stated for the peanut gallery reading this thread is that if Snipes (being a millionaire) had filed his taxes like he should have he most likely would have recouped most of that money.

(Reuters) - The U.S. Marshals Service has ordered actor Wesley Snipes to report to prison in northwest Pennsylvania no later than noon on December 9 to begin serving a 3-year sentence on tax charges, according to a notice filed in the U.S. District Court in Ocala on Wednesday.

Snipes has a motion pending before U.S. District Judge Terrell Hodges in Ocala asking to remain free pending an appeal to the U.S. Supreme Court. There is no indication in court records when the judge will rule. A federal court clerk said "any motion not ruled upon is deemed denied until ruled upon."
It might be interesting to see on what basis the appeal was requested but I suspect that filming of the next installment of the Blade movie series is on hold for the foreseeable future.
