http://www.nzherald.co.nz/nz/news/artic ... d=11502064A former South Auckland finance company owner convicted of possessing a knife asked a District Court judge for damages of $11.5 million while being sentenced for the crime.
I suppose that's true if you call a payday loan company a "finance company", He has somewhat unusual collection methods;
So why is he of interest to us?Gavin Marsich, who owned the PayDay Loans money lending service, was found guilty at trial of possessing a knife in a public place, after he held a meat cleaver at his shoulder while telling a client she must repay her loan.
And that meat cleaver?Judge Glubb rejected Marsich's claim that the New Zealand jurisdiction didn't apply to him, and dismissed his claim for $11.5 million in damages.
He said the $11.5 million claim for damages was based on the notion he is a "Freeman of the Land" and the law did not apply to him. He said the damages were for defamation.
It can happen to any busy multitasking executive. You're hacking away at a pig carcass on your desk while discussing the repayment terms on an overdue loan and the next thing you know you're in the slammer.Marsich rejected the judge's decision that his home, where he operated PayDay Loans. was a public place. He said the meat cleaver was kept at his desk because he chopped meat at his desk, and he never threatened anyone with it.
As far as the loans go that term is incorrect. His webpage denies that he makes anything as money-grubbing as loans. He doesn't run a finance company, he runs;
http://www.twentyfiftyclub.com/a Private Exclusive Club of Private Members that fund-raise as a hobby and grant assistance at a cost under a Personal Promise Agreement to people in need of the small necessities to cope with everyday living costs.
Finance companies charge interest but not Gavin!
