Here are the latest documents in the Pretend Attorney General case, linked to my server. Looks like he's STILL trying to get On Second Thought to film his trial (see new appeal), and pay close attention to document 741 and its attachments, as it seems the good Pretend Attorney General has been attempting to intimidate prosecutors, the judge, and possibly witnesses!

A large number of documents on the docket are sealed ex parte applications as to ATW and are not listed.

It's the apparent attempts to intimidate or threaten gov't employees and witnesses that is most concerning at this point.

What's most concerning to me is that there are nigh 750 docket entries in a case that should, from a layperson's pint of view, been a half day trial and a 10 year sentence. This useless phuckwit is trying to make it so that he gets a life sentence but is still released after trial with time served.

And that's all well and good, but he's taken up a considerable portion of the resources of a Federal Court with this nonsense. I mean, really, take him out back and put two in his forehead and be done with it already!

Looking at the current antics I have to agree that it seems that Williams actual "strategy" is to delay trial so long he ends up with time served by default (I believe I read elsewhere on here that you're usually credited time and a half while awaiting trial?) the truly worst part of that is that it shows in my opinion that he intends to go back to conning people when he gets out. Here's the plan as I see it: (1) delay trial at least six years, maybe even get lucky and have a motion or two to through (2) gain sympathy with the jury because of long incarceration and failing that get time served on 10 year sentence upon conviction (3) go back to the same con game in a different state using this "victory" as street cred while poor Rudy and other useful idiots signal boost (I call it the Hinkson strategy).

If he gets out on time served I wouldn't be surprised to hear him incorporate that into his conman sales pitch "I've heard some worrying things about you Mr Williams..." "Oh please if I was really a criminal would I have gotten time served? They only did that cause they knew it'd be thrown out on appeal! The whole thing was a farce because they don't want me helping good folks like you. But you know what they say you can't keep a good man down!" Or some similar spiel to convince the desperate and stupid that his arrest trial and conviction just PROVES he's not a con man and can actually work the finance voodoo he promises.

Credit for time served on federal cases is stated in 18 U.S.C.A. § 3585.
(a)Commencement of Sentence.—
A sentence to a term of imprisonment commences on the date the defendant is received in custody awaiting transportation to, or arrives voluntarily to commence service of sentence at, the official detention facility at which the sentence is to be served.
(b)Credit for Prior Custody.—A defendant shall be given credit toward the service of a term of imprisonment for any time he has spent in official detention prior to the date the sentence commences—
(1)as a result of the offense for which the sentence was imposed; or
(2)as a result of any other charge for which the defendant was arrested after the commission of the offense for which the sentence was imposed;
that has not been credited against another sentence.
No time-and-a-half. I'm not sure of the implications related to the possible sentencing for his violation of probation from Florida, this time incarcerated may just be credited to that? IANAL, so someone else may set me straight.

Canada is the place where folks typically get 1.5:1 credit for pretrial confinement (unless they're already serving a sentence for another crime).

The reason I see cited for this is that prisoners in Canada are typically released for good behavior when they've served two-thirds of their sentence, and pretrial confinement doesn't build up good-behavior credit in this way; so the 1.5:1 multiplier balances this out.

If this is indeed the reason, it seems like just allowing good-behavior credit during pretrial confinement would be more straightforward. But I'm sure that my lack of understanding explains why the Canadian authorities have never recruited me for a job in prison administration.

I've seen 2 days credit for 1 day in some pre-trial detention issues. I was told by someone familiar with the system that it's because remand, where they are generally held, is even more unpleasant than the regular jail.

I am pretty sure that he is either serving his Florida sentence while awaiting trial on Federal Charges and that means his Federal sentence won't even begin until he finishes paying his debt to the good people of the Sunshine State, or that when he is sentenced and begins serving his Federal Sentence, he will not be getting credit in Florida for what he owes them. All of which is at the discretion of at least two Judges, in that either one of them can decide that what the other one is imposing can count against what they are.

Did that make sense?

Lemme try again, and please someone correct me if I'm wrong... There is no law that says either one of the courts has to give him credit for time served for the other one, but either one of them can decide that they'll let him count the other side's time to what they want him to serve. Given his winning personality and record of cooperation its a shoo in that one or the other will do just that, if not just let him go anyhow because he's technically guilty but just such a nice guy.

Pretty accurate. Some of the remand centers are particularly nasty places - Edmonton Remand has a deservedly bad reputation. That part of the Canadian Penal system is a recipe for disaster. Throw two thousand inmates in a facility, no time to sort them, nasty hard cases awaiting trial in with weekenders, petty criminals, and yes, innocent people who haven't gone to court yet and bad things can and do happen.

New this week from the Pretend Attorney General are a number of government & court responses and orders to the stuff previously filed.

Of note: ATW was being a petulant git again, referring to the prosecutors as "dickheads" (doc #750) and refusing to go to court (#753 and Att A, #754).
It also looks like Anabel Cabebe is changing her plea (see #763 and #765, no document)

Links to my server, as always.

Documents 743-746 are sealed ex parte applications and aren't linked here.

Oh, come on Scott, fair is only fair, ATW is the very definition of if not the poster child for "petulant git" give credit where credit is just and due. :snicker: :haha:

So NO unmonitored access to phone, wonder why???? :snicker:

Seems like a slow week for ATW, looks like 5??? entries of self inflicted damage. As this rate he's going to have to hustle just to get to 800 before month end.

Yeah, I think that pretty well sums it up, and ATW was not at all amused that he didn't get his way. He sounds all petulanty and tantrumy to me.

Someone must have given him a new word of the day calendar.
