Brody James Whitaker, who once claimed he was a “sovereign citizen” and the “grandson of God,” was ordered by a Bantam Superior Court judge to return to Florida Monday to answer to charges of shooting at a state trooper.
Whitaker appeared for the last time at the Bantam court Monday, where Judge Corinne L. Klatt denied his petition for Writ of Habeas Corpus, which would have allowed him immediate release if granted.
Attached to Longwell’s draft for a Writ of Habeus Corpus was Whitaker’s own hand-written “Declaration to compel common law and restore lawful jurisdiction.” In that, he argued his sovereignty exempts him from penalty, since he is the “Sovereign Chief Ruler of my nation,” and he also changed his name from Brody J. Whitaker to Brody James Fink.
The lengthy document also states he has a copyright over both names.
Whitaker is wanted by Florida police on charges of aggravated assault of a law enforcement officer, aggravated fleeing or attempt to elude, resisting arrest and criminal mischief. The charges are related to an incident on March 25 during which he led the Florida highway patrol on a chase and fired shots at two officers.
Bantam Superior Court Judge Corinne L. Klatt told the defendant who was representing himself to "stop spewing out words you have learned in a law library and are not applicable in this court." Earlier today, she ordered Whitaker, who whad been arrested in Winsted in April after a nationwide manhunt, back to Florida "forthwith."
Good riddance to this sovereign looney! The judge showed him more respect than he deserved, frankly. I have never met a sovereign here in "the Constitution state", and I'm not particularly interested in going to meet them at the "Porcupine Festival", even as a curiosity seeker, in New Hampshire. If you sleep with dogs you will probably wake up with fleas.
Thankfully, he never exercised his Second Amendment rights.

The man who claims he is the grandson of God continued to defend himself in a Sumter County courtroom Thursday.
Brody Whitaker, 39, is accused of shooting at a Florida Highway Patrol trooper in March 2010. They chased him at speeds up to 130 miles per hour after he failed to pull over for a routine traffic stop.
Whitaker has a court appointed legal advisor, but in the fourth day of trial still seemed to struggle with some legal nuances.
At one point, Whitaker continued to argue why he should be allowed to ask a question.
"I already overruled his objection,” the judge explained. “Overruled means he can answer the question."
The charges are related to an incident on March 25 during which he led the Florida highway patrol on a chase and fired shots at two officers.
The officers were not injured.
Fortunately, his marksmanship is no better than his understanding of law.
