The 31 USC § 5101 mentioned on the homebrew license plate is simply the section (dating back to 1792 or thereabouts) that describes the decimal system of US coinage; y'nkow, dollars, halfs, dimes, etc.
I daresay that, since the Jerry Kane shootings, a homebrew license tag is going to get the motorist the undivided attention of the police (and probably more than just one policeman). And making a license tag at home may qualify the person for an opportunity to make the state's actual license plates.

I've seen a few homebrew plates here in Las Vegas Valley. One was a fake diplomatic plate (It had no country code), one was from the "British West Indies" (the fake nation promoted by RightWayLaw), and two separate pairs on the same truck (different times) both reading "Nevada Republic". The truck was seen in the parking lot of a post office.
Funny, how the driver will probably claim to be "exempt" from all sorts of federal law, but is still using a government owned corporation to send his mail.
