I may be over simplifying things here, but it comes across to me as plain old garden variety misappropriation of funds/embezzlement/FRAUD to me

I agree, nd. Obviously things have not been working right for a while inside Jevin and I am guessing that instead of admitting that his business was failing, Ptak doubled down to see if he could pull the fat out of the fire. Any sensible person would have shut down the venture before the losses became too great. I see this among small businesses all the time; the owners are motivated by pride, loyalty to their employees or the fact that the business is their only source of income. At that point, it is only a hop, skip and a jump to pushing the boundaries of policy, financial propriety and/or outright breaking of the law. The other alternative is, as you mentioned, greed and Ptak simply may have decided his personal lifestyle came before his customers. And it could be a combination of the two.

The only question that I have which has not been asked yet is whether Ptak was offering monies or gifts to those directors of the various leagues to continue their business with his company. It might explain why some people were still doing business with him.

It is always brilliant to sue the go between for all the leagues having money issues with you and that is working with the authorities. The authorities requested all the contact information from me for victims that had late or missing payments and directed me to send victims to them.

I have been checking in with the leagues that had financial issues with Jevin. Northeast Little League was never paid a dime of the $35,000.00 they were owed, but did get around a third of their registration monies through chargebacks. Southeast Louisiana Adult Soccer Association never got a dime of the monies owed from Jevin, but was able to recover much of it through chargebacks. The Texas league that has not gone public about this fiasco yet was owed around $10,000.00 and never received a dime from Jevin. One parent did a chargeback and the rest was simply never recovered.

Another league that has not gone public was owed around $15,000.00. Dan Ptak told them he wasn't getting the money they paid in because his Jevin accounts were frozen due to fraudulent chargebacks. Ptak seems to be blaming the dear folks at SkyView football for this when in reality they filed chargebacks as other leagues were already doing and counsel had advised in desperation to get their money. As Jevin hadn't paid them at the time they decided to initiate them, those chargebacks were not fraudulent. The league out $15,000.00 simply went into the Jevin system and reversed the credit card charges there in the Jevin system. Apparently, as Jevin's accounts were frozen the money was just sitting there in limbo. I had no idea that it was even possible to reverse charges like that. They are still out about a thousand dollars, but are just grateful that they escaped without greater losses as other leagues are facing.

Many of these leagues reported that Dan Ptak had threatened them with suit or non-payment. Some were offered partial payment or Ptak tried weaseling around and asked what they needed. They naturally insisted he pay them in full what he owed them from their registration fees. Sadly, the nightmare will never end as these folks will get tangled up in Jevin's and Ptak's crazy legal adventures. Jevin's contract in the court filing states money will be transferred the next business day. That should be the end of the story right there!

League president David Vann said Jevin employees have talked to him by phone, but continue to give him the runaround when it comes to explaining where the money is. “Dog died, sorry I’ve been out of town, I’ve been sick. We’ve heard a lot of excuses why they can’t give us the money,” Vann said.

With only three weeks left in the season and new bills, the league is in a tough spot. “I think this is stealing from children, and children pay the ultimate price,” said Jim Kenrick, a parent, coach and manager for the league. He’s appalled.

“It’s hard to believe that people would steal from kids’ futures and their ability to play,” Kenrick added.

Jevin never paid the first group and this second group is battling him in the harassment suit he filed against them. The victims in all this are the little kids served by these charities. If that clown thinks he is going to silence me he is in for a big surprise!

Several of the leagues that have yet to be paid are members of Little League International. I spoke with them this morning and forwarded a list of all their leagues that are unpaid and those that are still using Jevin. Obviously, as Dan Ptak has refused to pay leagues and paid some of their leagues months late they are very concerned. Now, learning that Jevin has taken the absolutely shocking step of suing one of these youth charities, its volunteers and the innocent parents of these kids, Little League International is going to be taking action. They have generously given their time to reporters and will do everything necessary to see that Jevin will not be able to harm any more of their members.

Ptak was adamant that his company distributed Sky View's money on time and said it has blown the situation out of proportion.

That is contradicted in the suit this clown filed. The contract he attached promises payments will be made the next business day. The dates he lists in the filing are certainly nowhere near the next day. Dan Ptak and Jevin paid weeks late only after a media storm, police involvement and the league consulting with counsel.

The owner of Jevin, Daniel Ptak, told ABC Action News reporter Michael Paluska that his software management company were victims of a fraud after Ptak claimed someone tried to steal the registration fees collected.

“The bank froze our accounts,” Ptak said.

Ptak would not comment on the group that he says tried to defraud his company. So, there was no way for ABC Action News to search for a police report verifying his story.

There is no police report, because Ptak is actually twisting the issues with Sky View Youth Football. He had paid them late and they exercised their right under the Fair Credit Billing Act to initiate chargebacks because "he had charged for goods and services that weren't delivered as agreed." Ptak not forwarding the registration money to the football league the next business day, but actually weeks late is the reason for the chargebacks. They initiated those chargebacks after going to the police, media and licensed attorneys and they were initiated well before he paid them weeks later.

Dan Ptak is lying when he tries to paint that as fraud and claims the money was stolen. Of course, he couldn't file a police report, so he ducked the reporter's question. He doesn't mention that he paid Southeast Louisiana nothing of the 31 grand he owed them and they had been doing boatloads of chargebacks during that time as well. SELASA just had not gone to the media yet. They still have yet to see a dime. They did participate in news stories published after this one and are speaking out about this outrage!

The law firm is not going to be too happy with Leann Diamond when this embarrassing fiasco comes to light in the press and they loose thousands carrying this case that is going to go nowhere. Suing volunteers running a charity for kids and the innocent parents is so despicable!

That was exactly what came to my mind when I saw that he had listed you in his filing. The last thing someone doing what he is doing wants is for ANYONE, let alone lots of ANYONES, to get a look at his communications, books, and financials. His records and bank records will show him to be a liar and a fraud. And while you are at it you get to look at everything he has done with his transfer agents, which add more proof of his mountain of lies. Really NOT a smart move on his part. Then you can also look in to his inappropriate relationship with your league president and see what they had going. Just really not a smart move on his part.

I have a few, well a lot really, thoughts on his lawyer. If the lawyer is at all competent, he has to know that Ptak is going to get his ass handed to him, and possibly even go to jail. I don't know how they do it in TX, but around here that sort of thing gets automatically referred to the prosecutor at the end of the trial. They take a VERY dim view of that sort of fraud here. I'm also wondering how he thinks he is going to get paid since I am pretty sure Ptak is pretty well tapped out. He doesn't strike me as the smart type, as witness going to court, so I doubt he'd have stashed any of it away and I'm betting he's mortgaged to the hilt and beyond.

A very clever legal strategy, providing proof that you lying out of both sides of your mouth in your court filing to sue someone else. Really clever that.

Something else he can't do is file a police report on the "theft" as then the police would look in to it and find out what really happened. Or worse, get the FBI involved if he claims his bank was involved. This guy is a whole lotta stupid.

Chances are the parties are going to be ordered into mediation first. (FYI, the firm she's with is no lightweight.) IMHO that's their objective; typically, a condition of the settlement keeps everything private.

While he said he couldn't discuss details of the dispute, Ptak said the bank his company uses to handle the transactions put a hold on Jevin's account activity. And that has frozen disbursements to the Northeast Little League.
"Basically people submitted to their credit card company that they didn't get the goods or services that they paid for," Ptak said. "And (the bank) is still holding funds."

Tampa Bay 13 contacted Jevin and learned several parents, both locally and across the country, were charged twice during online registration.

After many of those parents contacted their banks about the charge, Jevin officials said it triggered a fraud investigation with Merchant Bank, who handles Jevin's money.
Jevin officials claim until the investigation ends, they cannot turn over funds.
"It's hard to explain to a 13-year-old who's told to do the right thing, always tell the truth,
and yet, I have to tell him that his little league was just robbed, basically," said parent Kelly Ewert.

According to Jevin, a freeze was placed on all the accounts the company has due to a youth football league in Utah demanding refunds.

Jevin President Dan Ptak said the situation would be rectified.
"Well the money is being held by the merchant bank," Ptak said. "They have not released the funds to us, therefore we don’t have the funds to release to Northeast."

So, Dan Ptak, which is it? Is Jevin software so dang crappy that there was a slew of double charges again? Garland soccer went through the hell of double charges due to this crappy software a few years ago. Was Jevin software really a victim of a fraud as someone tried to steal the registration fees collected? Again, we are waiting for the police report on that one. Or, have the leagues doing chargebacks across the country to get the money that Jevin owes them the reason the accounts are all frozen as Dan Ptak reported. These weren't refunds as he characterizes them. The parents paid money for registration that their child's league needs to run its program. When Jevin couldn't pay the leagues the money collected, the parents had to do chargebacks so that their children could play. Jevin is ripping off charities that serve children! Liars can't keep their stories straight!

OK, as someone who used to deal with this nonsense for a living, I can tell you that THE ONLY REASON the bank/processor, froze his accounts, was because they suspect HIM of fraud. You don't get those kind of chargebacks otherwise. And those kind of chargebacks do not make the institution happy. Refunds are one thing, chargebacks are a whole other matter and can get your account closed real quick.

If there had been fraud against him, they would simply have closed the affected account(s), monitored the transactions, and opened a new one for him. Doesn't look like that happened does it?

I also suspect at this point that he will NEVER EVER be able to get a merchant account again. Banks/financial institutions take a VERY dim view of this sort of thing as they can end up on the hook for those chargebacks. If he hasn't complied with his contracts and has taken money by card, then the bank is obligated to refund on the chargebacks whether he has any money left in his accounts or not. I would bet you that their loss prevention/read fraud departments are looking very closely at ALL his transactions right about now and someone in LP management is not a happy camper.
