This foreclosure rescue deal is selling itself MLM style. We have a long thread over yonder:

The icing on the cake is that these clowns have filed a number of lawsuits and the court docs are proving to be quite interesting. The following links contain the pdfs from a sampling of the filings:

The biggest red flag is George Dranichak / Zachary / Sviat or whatever he is calling himself these days removed the very informative thread and sold this scam an advertising spot on the Scam.com forum. Luckily a birdy archived the thread and sent it my way.

At what point could the Bella bunch be declared vexatious litigants? They seem to be filing a lot of very similar cases across the country as they try to strong arm mortgage holders.

Good luck, strong-arming banks. In one the cases you cited (the Colorado case), the bank filed a detailed summary judgment motion a couple of days ago. They'll probably win. If this keeps happening - especially if, as it has done in the past, Bella doesn't even answer - then any jurisdiction in which it has done this more than once may go the vexatious litigant route. However, vexatious litigant is a jurisdiction-by-jurisdiction affair, since one court can't bar someone from filing in another court. More likely (and more effective) are monetary sanctions under FRCP 11. On a Rule 11 sanction, a court can (and frequently does) consider whether the litigant has done similar sanctionable conduct elsewhere.soapboxmom wrote:At what point could the Bella bunch be declared vexatious litigants? Man, this sets some kind of record.
The U.S. and the State of Colorado file suit against Bella Homes (docket 12-cv-390, CO) on February 14, 2012. Essentially they allege a fraudulent scheme to defraud banks and homeowners: "deed your home to us, lease it back from us, we'll handle the bank". Five weeks later - five weeks - the Court enters the following order, reproduced in its entirety:

I don't see how this can fail to result in indictments.Pursuant to the Consent Judgment in the above-captioned case entered by the Court on March 20, 2012, and pursuant to the admission of Bella Homes, LLC, by its authorized representative, acknowledging its role in defrauding homeowners who signed over title to their homes to Bella Homes, it is hereby ORDERED, as follows:
All deed transactions conveying title or interest in real property to Bella Homes, LLC by any person are void ab initio.
