Ottaviano & Co sentencing still set for Oct 18th.
Unless something has come up that I'm not aware of, sentencing day for Ottaviano and the rest of the MATA crew is still set for next Tuesday--October 18th.
The only significant filing since the end of the trial was Ottaviano's request to be allowed to go free until the sentencing for medical reasons--primarily COPD/some kind of blockage that caused him to have no detectable pulse in one of his legs. When addressing the issue of why he is only just getting around to seeking treatment for a condition he says he was diagnosed with years ago, he wrote that he had been treating it homeopathically but has decided to pursue traditional medical treatment since the homeopathic remedies were ineffective.

How convenient. He spent years treating his condition with alternative medicine (and still seems to get around OK). Then right before he has to go to jail he "sees the light" medically and tries to use that as an excuse to prolong his freedom.

Sentencing has been postponed.
The sentencing of Ottaviano, Foster, Balice and the rest of the MATA crew (which had been scheduled to take place this past Tuesday, 18 Oct) has been postponed while Judge Martini handles a rather complex case that could go on for another month, or more. Unless there's a lull in the current trial or it takes less time than anticipated, Ottaviano and Co. could wait up to 6 weeks or longer before they're sentenced.

Sentencing rescheduled AGAIN--now 29 Nov, 11:30am.
And the sentencing has been moved/rescheduled again. No idea why, yet. (Probably the bond/health thing.) We'll see. *sigh*

Ottaviano hospitalized, wife asking permission to visit.
Ron O. had surgery last week (at East Orange General Hospital ) "to put a stent in his heart. He was also given a stress test to determine if he could undergo vascular surgery on his legs." On Friday, 11 Nov, he was transferred to another hospital and his wife (Harriet) was informed that he was in critical condition, having "suffered 'something like a heart attack.'" The next day, they told Harriet that he was moved to the critical care unit.
Given that Ron O. was placed in the custody of the Marshals Service immediately after the trial, they are enforcing the terms of his incarceration, which includes not allowing his wife to see him. Under the circumstances, Harriet has asked for a court order that would allow her to visit her husband during usual hospital visiting hours. (There is a US Marshal guarding him at all times.)
No idea if his condition will delay the sentencing again, or if they will simply go ahead with it since there are other MATA principals and employees to be sentenced, as well.
Time will tell.
I imagine that Judge Martini will cut Ottaviano (and Harriet) some slack and let her visit him.

Apparently, the sentencing has been postponed yet again. Nothing on PACER yet, but I imagine it's related to Ottaviano's health issues. I'm speculating there, so we'll see.

Sentencing: Same day, new time. 15 Dec, 11am.
The sentencing time has changed, but not the date. It's not up on PACER yet, but it's now set for 11am, *not* 1:30pm. Oh, and the only parties being sentenced at this time are Ottaviano, Balice (I think...), and Harriet Foster (O's wife). The remaining parties in the MATA crew have a different sentencing date/time. I'll post it if I know it, but since PACER doesn't seem to be up-to-date regarding Ottaviano/Foster/Balice, it might be wrong about the rest of them. I'll look into it.
Yes, I'm going to head down there. I wasn't planning to, but I think a bit of closure would be cathartic, if not a tad sadistically rewarding. I won't be able to do any real-time reporting, but I'll try to give y'all a rundown when I get home.
