The editor of the book, Boston Tea Party Book Michael Scott Ioane has been ordered by Magistrate Judge Snyder of Fresno, CA to remove his name from the site: http://www.bostonteapartybook.com.

NOT because he isn't, in fact, the editor, but because the name links to another site that gives business advice. The order from the court is that since it links to another site, he is giving the impression of providing tax advice.

What?? Are you kidding? Are we as web site owners responsible for claims of service made on sites we link to now?

Anyone know of the legality of this kind of thing? Or is it just another knee-jerk reaction to the Boston Tea Party demonstrations coming up?

Correction: The site linked to does not give "business advice." It is Ioane's scam bait site. Linking from one scam site to another is illustrative of how these things are used to lure people into trouble.

These are very different statements. bostonteaparty's story keeps "evolving" with every new iteration. And, given the ways in which TPs tend to twist words to increase their victomology, I suspect pre-trial services verbal statement may have been quite different than what bostonteaparty is leading us to believe.

The only criminal action for Michael S. Ioane is in the Eastern District of California, 1:09-cr-00142-LJO-3.

A check on the docket shows orders by Magistrate Judge Sandra M. Snyder, the same MJ that "bostonteaparty" is complaining about.

The complaint alleges that Ioane, doing business as "Acacia Business Solutions," "First Amendment Publishers," and other entities, engaged in a conspiracy to evade income taxes using, among other things, fake corporations and trusts.

The link in question seems to be from a promotion of a book published by "First Amendment Publishers" to a website for services provided by "Acacia Business Solutions," which services include the creation of corporations.

In other words, the link seems be from one Ioane web site to another Iaone web site, and could be part of a plan to direct people interested in evading taxes to services to help them evade taxes.

The orders setting the conditions for Ioane's release have a number of Internet-related conditions, including that he not have any access to the Internet, terminate his Internet access, make his computer available to the Pretrial Services Officer for inspection from time to time, not provide tax advice, not be involved with trusts, and not promote, manage, or consult on any corporation, trust, or limited liability company.

Telling Ioane to sever the link between the tax book and the "business services" web site might have seemed to the MJ and PSO as steps necessary or appropriate to enforcing the conditions of release, and they might have told him to do it or risk being returned to custody. (Although I don't know how he would change the web page without access to the Internet.)

have limited access to a computer for business purposes for formation and advisement for corporations, and articles of corporations; said access is restricted to a computer on which monitoring software is installed.
all other previously ordered conditions of release not in conflict with this order,shall remain in full force and effect.

It was a verbal order from pre-trial services. The person's name is Jacob M. Scott, who stated it is what the judge requires.

And if you're Michael S. Ioane, you'll comply with the "order" or run the risk of having your bail revoked for violating the conditions of your release.

But if you're not Michael Ioane, then who are you, and why do you care?

A check of "bostonteapartybook.com" shows that the domain is registered to:

But I can't find any evidence that any lawyer has an office in that building.

The name listed for the administrative and technical contact is "Rothchild, Michael mike@acaciabusinesssolutions.com". That email would, of course, be the other domain used by Ioane, and might even be an email address that Michael Ioane might use.

The telephone number for the administrative and technical contact is "7758411876". A Google search of that number says that it is owned by....

So the book editor, the domain, and the website designer are all Mike Ioane. The only other person who could care about the book and the website is the "author" of the book.
