Probably the costs of the bailiffs, shuttering, security guards and storage of effects. Along with the legal costs.

AIUI they all get added to the debt owing to the lender.

£246K is a LOT of costs. Maybe that includes a newly-imposed sov surcharge.

Back of a fag packet calculations were they'd be billed at around £20 an hour each.

Maison tobe was finally sold at auction this morning (for the second time) for £320,000. He has now put Saville estate agents on notice because fraud something or other. Played the silliest game and won the best ever bumper prize

There was one for when Neelu staged her protest at Peel Close's auction... but sadly it didn't make the programme :snicker:

Of course now having been sold, Tobe can land himself in a lot more legal jeopardy if he tries to break in again.

Dear Officers:
We write on behalf of The House of Leigh Trust (HOLT) (the “Trust”), acting by its Trustees. This letter serves as formal notice that the Trust intends to file an urgent application in the High Court of Justice (Chancery Division) on 18/19 March 2025 to challenge and set aside any purported sale, transfer, or enforcement action relating to 39 Glebe Lane, Maidstone, Kent ME16 9BB (Title Number K295529).
1. Immediate Court Action
Filing Date: 18/19 March 2025
Nature of Application: Among other relief, the Trust will seek an injunction or stay against any marketing, sale, or transfer of the above-referenced property. We assert that the property was wrongly treated as part of a bankrupt’s estate and/or used to secure a charge that has since been invalidated by reason of disclaimers and other procedural defects.
2. Obligation to Notify Potential Buyers
Statutory Disclosure Duties: Under the Land Registration Act 2002 and the Law of Property (Miscellaneous Provisions) Act 1994 (“the 1994 Act”), any party selling a property with actual or constructive knowledge of a dispute must disclose it to prospective purchasers.
Section 6(2)(a) of the 1994 Act: Matters publicly recorded or otherwise known are deemed to be within the buyer’s actual knowledge. Consequently, any new buyer cannot later claim ignorance of this ongoing litigation once the dispute is on record.
3. Variations to Title Guarantee & Buyer Risk
Full vs. Limited Title Guarantee: Standard transfers may imply the seller is responsible for ensuring good title. However, these obligations are sometimes restricted or varied, shifting the cost of rectifying title defects onto the buyer.
Practical Effect: Prospective purchasers may inherit the burden and costs of any legal challenge to the title. They must be clearly warned of the Trust’s forthcoming High Court action to avoid future claims of misrepresentation or nondisclosure.
4. Specific Challenge & Bankruptcy Issues
Unlawful Inclusion in Bankruptcy Estate: The Trust contends that the property at 39 Glebe Lane was wrongly included in bankruptcy proceedings, despite disclaimers and equitable interests existing in favour of HOLT.
Invalid/Extinguished Charge: We assert that any charge registered by Bank of Scotland PLC or pursued by any trustees in bankruptcy is no longer valid following disclaimers under the Insolvency Act 1986 and related regulations.
Procedural Defects in Enforcement: Enforcement via a High Court writ, bypassing mandated County Court processes, runs afoul of regulations such as the Mortgage Repossessions (Protection of Tenants etc.) Act 2010 and the Dwelling Houses (Execution of Possession Orders by Mortgagees) Regulations 2010.
5. Demand & Required Actions
Cease Marketing and Sale Efforts:
Immediately halt all marketing, auction, or transfer efforts regarding 39 Glebe Lane.
Disclosure to Prospective Buyers:
You must disclose this dispute to any prospective bidder or purchaser, given your actual knowledge of the pending litigation and alleged title defects.
Confirmation of Compliance:
Please provide written confirmation within 24 hours that:
You acknowledge receipt of this notice;
You have informed (or will inform) all interested buyers of the pending dispute and our imminent legal application; and
You will suspend any sale or completion until a final court determination is rendered.
Reservation of Rights:
We reserve all rights to seek injunctive relief and/or damages if the sale proceeds despite this notice. Should a sale occur without proper disclosure, all involved parties may be liable for resulting losses.

Something to do with a Trust? He did the freeman favourite of putting the house in a trust some time ago.

That's £20k pw, for 8-10 weeks, plus all the shuttering & fencing required to stop Team THL's frequent attempts to break in. Probably all commissioned from a security firm with management overhead & profit costs. Easy to see how it added up to £240k.

And then, as if he hadn't hurt his own interests enough, THL demands that the auctioneers must inform bidders that the property is blighted by his own Irredentist nonsense, in hope of depressing the sale price further. It's like he heard a rumour that there might be some monetary surplus for himself at the end of this, and set out to ensure his own penury.
