That would be the sensible thing to do, if only to buy some time for a better resolution. But he still owes them £43k, plus a whole lot of legal costs. True. But B&B will still be open to a last minute deal if it it going to save them time and effort, and obtain the cash that is owed to them. The problem may be that this approach is often used to further delay the inevitable, because selling the house by Tom can be drawn out for months.
