UPON the Application dated 27 November 2014 ("the Application")
AND UPON hearing Niall McCulloch of Counsel for the Applicant and Paul Fisher of Counsel for
the
Second Respondent and the First Respondent in person
IT IS DECLARED THAT the Applicant (as Trustee in Bankruptcy of the estate of the First
Respondent) is beneficially entitled to a 50% share in the freehold property known as 89 High
Street, Stotfold, Hitchin SGS 4LH registered at HM Land Registry under title number BD 173016 ("the
Property");
It is ordered that
1. The Property be sold with vacant possession and that the First and Second Respondents do
co-operate in. such sale;
( /The conduct of the sale of the Property be given to the Applicant as trustee in bankruptcy of
the estate of the First Respondent;
3.The First and Second Respondents do join with the Applicant and do all such things as may be
necessary to procure the said sale of the Property with vacant possession;
4. The First and Second Respondents do deliver up vacant possession of the Property to the
Applicant by 10 January 2016;
5. The First Respondent be and is hereby removed forthwith as joint trustee of the sale and the
Applicant be appointed in his place under Section 41of the Trustee Act 1925;
6. The Applicant do have power to execute all necessary deeds, documents and instruments relating
to the said sale;
7.The First and/or Second Respondent do pay the Trustee's costs of and incidental to the
Application (the First and Second Respondents being jointly and severally liable for the
payment of the said costs), such costs summarily assessed in the sum of £30,599 to be deducted
from the Second Respondent's share of the net proceeds of sale of the Property;
8.To the extent that the aforementioned costs are not met as per paragraph 7 above, the
Applicant's costs of and incidental to the Application be paid an expense of the bankruptcy of the
First Respondent;
9. A sealed copy of this order will be served by the Applicant on the Respondents.
