Well, like any rule, if a CCJ isn't enforced it doesn't mean much. Aside from a lousy credit rating and a world of pain coming, not merely from the creditor, but also the courts.

If I understand the rules correctly, if a court orders Andy to pay Bill, and Andy could but doesn't, the court can send him to prison.

This would be under CPR 81.4.

The Debtors Act 1869 s5 has:
... any court may commit to prison for a term not exceeding six weeks, or until payment of the sum due, any person who makes default in payment of any debt or instalment of any debt due from him in pursuance of any order or judgment of that or any other competent court.
(2) That such jurisdiction shall only be exercised where it is proved to the satisfaction of the court that the person making default either has or has had since the date of the order or judgment the means to pay the sum in respect of which he has made default, and has refused or neglected, or refuses or neglects, to pay the same.

So I suppose what it'll boil down to is what the Court order him to do after he's attended Court as ordered.

Yes. If GOOFy andybreck explains that he can't pay, he needn't worry about prison for that. His best bet is to attend the August hearing and grovel. I'm sure the court would be reluctant to bang him up. But if he goes into court and says he could pay but won't because he's lost his name and the court is corrupt and yada yada he can expect little sympathy.

Hi all,

Great forum and a great resource for people.

So this happened today.

I attended local County Court on the back of a suspended committal order which was posted to me alongside an attachment of earnings order.

The order mentioned I must attend court on 4th July and fill out the attachment of earnings order sheet and send back to the court within 7 days of receiving the order (problem is the Bailiff posted this through far too late and it had already surpassed the deadline).

Any way long story short I went to court today, sat my hind down in the waiting room waiting to be called.

Got called in and I immediately was told to sit down. I then informed the so called judge that "if you don't mind I would like ot stand with full reservation of my God given, natural unalienable rights" to which she replied "fine you can stand if you wish to" (notice no jurisdiction was claimed).

I was then asked to identify myself. I informed the judge that the legal fiction she was after cannot attend the hearing today as the fiction is currently sitting in Home Office's filing system somewhere (visa application for my wife).

Notice I didn't refer to my birth certificate but she then asked "I see so MR ADNAN KHAN is the birth certificate?" to which I replied "Yes".

She then continued "and you're the physical representation of it?" to which I replied "I am the only legally authorised representative and agent for the legal fiction".

I then asked the judge "In order to aid with these judicial proceedings may I asked if you are acting on your oath of office?".

She immediately got flustered and exclaimed "I am the judge presiding over the matter today". I then asked for her oath again to which she said she didn't need to produce because she didn't need to. I then asked "what do you mean you don't need to?".

Anyway this went on for a bit and she said if I wasn't going to fill out the form I would be sent to prison. I then asked her for her oath of office again and she said she would adjourn the hearing for 5 minutes. I then exclaimed " any completion of this form would be done under protest and duress as you're threatening me with imprisonment."

I walked out towards the court ushers (waiting area). Sat down and 40 MINUTES had elapsed, not 5 like the judge said..... turns out she was on a conference call, possibly seeking advice?

I got called back in, I then asked for her oath again then told her "as far as I am aware you could be impersonating a judge and I need to establish these judicial proceedings are lawful, it's a very simple request which I believe is quite reasonable".

The interesting thing is she was trying to play clever as the second time I got called in she wanted to make sure the usher had the paperwork that I had (in her hope completed and signed) so that he can give it to her (which he did).

She noticed how the paperwork was incomplete as I failed to mention my outgoings.

She then kept further advising me how the court had jurisdiction and she was the judge bla bla, at no point did she establish jurisdiction nor did I let her.

She then got fed up and said she was going to hear me again in 1 hour as she had other matters to deal with. I then exclaimed "the court takes notice the judge has once again failed to provide evidence of her oath of office and prove these proceedings are lawful, I will return with the same form I've been asked to complete under protest and duress".

So I wait an hour and I get called back in again, note: the usher asks for my form, I tell him I am capable of handing the paperwork over myself".

I walk into the court room for the third time and inform for and on the record that I am re-establishing common law jurisdiction.

She then said "oh I notice actually that district Judge Exton's original order was to fill out the form in May and if not you would go to prison for 7 days".

Well it turns out the lady sitting before me was NOT Judge Exton as she referred to her in 3rd person perspective.

I then tried to get her to honour her oath, at this point the usher was still inside too waiting for further instructions.

In the end she failed to act on her oath of office and I exclaimed the below:

"For and on the record the court takes notice the judge has failed to provide her oath of office, and has failed to provide a contract with full disclosure between myself and Cabot Financial UK Ltd, there has been no evidence to show Cabot Financial Ltd loaned monetary funds to myself and that we are dealing with a civil matter and not a criminal matter and as such I dismiss this case with cause and prejudice".

She then just got off her chair and said "Judge Exton's order still stands".

We both then walked out.

So after me rambling on my question here would be since I maintained honour throughout and asked her to act on her oath. I also informed her she constituted misconduct or malfeasance in public office.

Do you think it's likely the coppers will come and arrest?

Would you advise I submit a motion to dismiss with my reasoning to the court point for point and get this signed by a notary public(of course mentioning no change in lawful status for using a notary public)?

Your advice is appreciated

So... it takes this guy 25 paragraphs to figure out that the current judge is ruling on a different judge's order?

We see four officers and one bailiff trying to deal with the shouty Chantelle who is complaining that she has been assaulted because the Bailiff, following a court order entered her property.

What is of interest is that one of the officers, a rather large bearded chap, tells her to cut the Freeman of the land stuff out because it doesn't work. Of course Chantelle has none of it and accuses the officers and bailiff of behaving antagonistically, perhaps oblivious to one definition of the word (to act in opposition).

Perhaps he has done his homework on the subject. Even if you somehow missed the relevant bits of history in school, it does not take much Googling to realise it's a sham.

Down in the comments section Pre82 says, "All bailiffs and police need to be shot through the head."

I suppose one could say I make too much of this comment, but it isn't the first time folks in the freeman subculture have tried to talk themselves into violence.

If you think I am being am alarmist I would draw your attention to the numerous instances in which freemen have threaten and actually visited violence on others, especially police officers. . .the same people Pre82 says ought to be shot.

Freeman gurus have tried to pillory me for pointing out that they and many of their fellow freemen have made a habit of characterizing police officers, judges and procesutors as subhuman criminals and as such are deserving any violence visited upon them.

But they are wrong. Inciting violence is a step toward the sort of chaos and anarchy freemen knowingly invite.

I say "shame" on these freemen.

Sometimes I wonder though, which came first, the total disrespect and contempt for Law enforcement, the legal system, and the Government, to the point where they openly discuss using violence to combat, or their Freeman beliefs. I think sometimes the hatred and violence comes first, and the Freeman excuse is used as another way to justify this position. So while there is a connection, it may not always be causal.
