Jurisdiction

Post by LPC »

Tax protesters love to jabber about "jurisdiction," and there's a quotation in today's NY Times that might give them grist for their mill.

In dismissing one of the cases against the alleged "unlawful enemy combatants" at Guantanamo, one of the military judges, Army Col. Peter E. Brownback III, stated from the bench that "A person has a right to be tried only by a court which he knows has jurisdiction over him."

So a court cannot have jurisdiction over a tax protester unless the tax protester *knows* that the court has jurisdiction?

I suspect we will begin seeing that, but military law is its own beast. (Besides, the TPs refuse to submit to admiralty jurisdiction. Why would they recognize martial law? :) )
