Some of you simply lack the attention span to get this so I am going slow. The foreclosure hearing was scheduled for the 22nd but look at the date on this secret foreclosure hearing!
Poor Ronald Roy! He demanded a that Deutshe Bank bring the original note to the foreclosure hearing and when he got to the hearing the clerk of court informed him that he must not really care much about his home because he missed the very important foreclosure hearing held in secret on the 16th, the same day by the way, that Deutsche Bank was served with the subpoena duces tecum!!
Poor Ronald Roy! You might wonder what would drive a man to negative averment and maritime liens – and putting liens on IRS agents and such!
Just so nobody accuses me of hiding links, here is some related information to indicate how Duetsche Bank is. You might especially get a look at the witness list! Of course that will bring out the best of denial around here.

And to me. Could you explain what that second document is, again. The "signature" scrawled on it certainly has no legal meaning, and I have doubts as to how MARITIME OR ADMIRALTY JURISDICTION got into a state court docket.

In lieu of doing things that would result in actual fees earned, I have spent some time researching the saga of the Hoodenpyle Peccadilloes. Much as it pains me to admit it, there is something at least superficially questionable about the timeline for this foreclosure.
The motion for an order authorizing the sale was filed 11/5/07. The Notice of Sale was published 11/21/07. The sale was first noticed for 1/2/08, then continued to 1/16/08. None of this was 'secret'.
In the meantime, the Rule 120 hearing was scheduled, then continued to 11/27/07 then was vacated. Rule 120 on its face allows the debtor to raise only the defenses of no debt owed (i.e., there has been no default), or Soldiers & Sailors Civil Relief Act. However, in practice, the courts also allow the debtor to challenge the creditor based on real party in interest or any other substantive defense to foreclosure. That hearing was reset for 1/22/08.
In the meantime, the property was sold on 1/16/08, as previously scheduled.
RonRoy evidently wanted his subpoena to compel the bank to 'produce the note' at the time of the rescheduled Rule 120 hearing on 1/22/08 so he could show DB was not the real party in interest; by then, the property had already been sold, not by a 'secret hearing' as DMVP claims, but by the properly noticed trustee's sale. It seems to me the sale should not take place until after the Rule 120 hearing is resolved; however, the rule also requires the debtor to file a verified response five days before the hearing; if that is not done, the court can dispense with the hearing and authorize the sale. So if RonRoy didn't file his papers in time, but instead just planned on showing up on the 22nd, the court may have already approved the sale based on his failure to file five days before the hearing. Evidently RonRoy tried to appeal (the docket shows an entry for 'Mandate from Appeals Court') but orders on Rule 120 motions are not appealable. So while I certainly wonder how and why it came to pass that the Rule 120 hearing was not scheduled until after the sale, neither the sale nor the hearing were 'secret' and it was probably RonRoy's responsibility to seek an order staying the sale if he had a substantial defense to the foreclosure.
As is so often the case with DMVP, there's less to this than meets the eye.
