All Caps Nonsense

Post by Lawprof »

One of my favorite alternate universe arguments is the one that your name in ALL CAPS is not "you" but some other entity that you can disavow. One of the arguments is that nowhere else is your name given in all caps. Go visit your local cemetery: all the gravestones are in all caps. Is that because the straw men are buried there and the real corpses were stolen by the Feds (or worse yet, they were kidnapped and are toiling away as some kind of zombie labor?!)

Hi Prof and welcome,

I am bringing cases against a couple of those all caps people. The funny thing is that they usually file UCC financing statements with the state AG against the ALL CAPS entity, claiming themselves to be a secured creditor of the ficitious corporation our office creates....love those fictious corporations.

So what you end up with is John J. Doe as the secured creditor against JOHN J DOE, debtor, with the same address listed for both.

For some reason, I'm seeing the john doe: Smith crowd more lately, although I do have a couple ALL CAPPERs. That cracks me up more. I heard one explanation of the ":" in the name in which he stated that if you took away the colon from the time on a clock it would become a fiction, thus, removing a colon from a name produces the same result - a fiction. TPs are a never ending source of amusement. Otherwise tax law would get a bit boring.

Welcome taxprof.

Removing one's colon causes one to become a fiction? Lord, I thought making them lug that bag around was bad.

Since you teach the UCC, you'll find the UCC arguments and tax lien arguments made by some of the folks completely confusing.

I find the analysis set out at various places concerning the common law entertaining, as well. See the arguments about Erie RR v. Thompkins.

As an ex law prof, I am truely amazed at the "logic" exhibited by these nuts. For grins, also try http://www.suijuris.net.

Welcome to the fun house.

What's weird about these syntactic arguments is that, for all the claim to worship "common law", there is no historical precedent. The further back in time you go, the fewer punctuation rules you have, and the more variation of usage. So when Shakespeare famously spelt his name several different ways on the same contract, no one thought he was trying to substitute a corporation for himself, they just thought he was being a wise guy. Also, way back, before there were lower case letters, no one claimed that everyone was a corporation.

Language changes over time, not only in punctuation, but in word usage, grammar, syntax and even the preferred meaning of a word.

In Shakespeare's time, calling a girl nice would have gotten your face slapped by her. At that time "nice" meant some one with "round heels" who fell into bed very quickly. A slut.

On the plus side, we no longer use the word "murple."
Re: "nice girls"; see also ZZ TOP, that li'l ol' band from Texas, and the song, "LaGrange," which says, about the Chicken Ranch, "lots of nice girls out there."

Ben Franklin liked to change the spelling of his own name on a whim too.

There's even a historical document between two founding fathers (I'll dig it up if anyone is interested) on whether or not to capitalize nouns (one thought it was dignified, the other found it stuck up.)

The funny thing is that most of their arguments are circular at BEST and usually misconstrue or misread the law. 9 times out of 10 there is a simple answer to their quandary which they choose to ignore.

The Illuminati have been working closely with the moderators at Sui to close the rift between dimensions. With Prejudice. Closing registration is the first of many steps. The repeated injections of reality from Quatloos members at Sui have widened the rift considerably, so we may have to start banning and deleting all such posts.

Several members of this dimension are planning to protest outside Sui's locations. If you want to participate, call your local SSDI or Unemployment office for directions.

Oh...while we're on this brand of crazies, don't forget the ones that "copyright" their names and then say that you can't use them without permission. I have one that occasionally send me bills for unauthorized use. I think I'm in the six million range now.

Sorry Dave, it says that registration is disabled when you click on it, before you enter any info. I'm guessing the site is run by a handful of friends who are like-minded. Some are truly paranoid-schizo and the others are scam artists. The foolish stumble on the site not knowing it's a set-up.

Did you see my other post? I'll pay you (I'll give you an American Silver dollar -- worth about 10$ to 15$ by current stds) in exchange for a true copy of what you filed re: your scooter.

Yep. I saw it and responded...

Have Demosthenes post the docket and note I am telling you the truth when I say that the Manhattan Judgment docketed a week later came back to a suitor postmarked September 12, 2001. It simply had a sticky on it saying, "Thank You."

I remember the security guards had some kind of problem with me having no government employee ID card a week after 9/11. So the clerk came to the lobby and escorted me in to file it - apologizing for rejecting such a monumental judgment while the Towers came down.

It will take a little to get out of mothballs but call (303) 844-3433 and order it up on the information - of course you might enjoy asking, "Could you search for any cases against Jesus Christ?"

When the CIA delivers the package, note it will be opened to the map of Manhattan Island. Specifically a map found in the Jewish Encyclopedia marking all the Jewish claims there.

David Merrill.
About the all upper case birth certificate bond; you should be aware that the Manhattan Judgment cured thirty days after Richard Grasso chose to ignore my BOE:

Now that is one for your wall. So many people are ordering up certified copies of that, I just had to catch a picture of it on the screen by coincidence one morning. Call my clerk, (719) 520-6200 and ask for Reception #201099293 and the proof of service #201101604. They will be glad to send them along for a few FRNs.

Don't forget that other case from 1995.

The document you call the BOE is still too small on my screen for me to read it all. I can tell you that merely writing some legal sounding gibberish on a piece of paper and filing it is no accomplishment: I know incompetent attorneys who do that every day. I'll be shocked when you finally get some actual money out of one of these wacky documents of yours.

That is just one example where the administrator chose not to use a comptroller warrant.

But there are medical doctors using the BOE as assurance bond instead of malpractice insurance. And it bonds about 200+ true judgments in common law res judicata.

Sorry to shock you like that!
