"Dirty Dozen" for 2013

The IRS has released its list of the "Dirty Dozen" tax scams to avoid for the current filing season (IR-2013-13), and the list is dominated by identity theft and simple, no-nonsense frauds. However, items 8-10 and 12 include some of the crazy stuff.
*False Form 1099 Refund Claims*

In some cases, individuals have made refund claims based on the bogus theory that the federal government maintains secret accounts for U.S. citizens and that taxpayers can gain access to the accounts by issuing 1099-OID forms to the IRS. In this ongoing scam, the perpetrator files a fake information return, such as a Form 1099 Original Issue Discount (OID), to justify a false refund claim on a corresponding tax return.

Don't fall prey to people who encourage you to claim deductions or credits to which you are not entitled or willingly allow others to use your information to file false returns. If you are a party to such schemes, you could be liable for financial penalties or even face criminal prosecution.

*Frivolous Arguments*

Promoters of frivolous schemes encourage taxpayers to make unreasonable and outlandish claims to avoid paying the taxes they owe. The IRS has a list [ The-Truth-About-Frivolous-Tax-Arguments-Introduction ] of frivolous tax arguments that taxpayers should avoid. These arguments are false and have been thrown out of court. While taxpayers have the right to contest their tax liabilities in court, no one has the right to disobey the law.

*Falsely Claiming Zero Wages*

Filing a phony information return is an illegal way to lower the amount of taxes an individual owes. Typically, a Form 4852 (Substitute Form W-2) or a "corrected" Form 1099 is used as a way to improperly reduce taxable income to zero. The taxpayer may also submit a statement rebutting wages and taxes reported by a payer to the IRS.

Sometimes, fraudsters even include an explanation on their Form 4852 that cites statutory language on the definition of wages or may include some reference to a paying company that refuses to issue a corrected Form W-2 for fear of IRS retaliation. Taxpayers should resist any temptation to participate in any variations of this scheme. Filing this type of return may result in a $5,000 penalty.
*Misuse of Trusts*

For years, unscrupulous promoters have urged taxpayers to transfer assets into trusts. While there are legitimate uses of trusts in tax and estate planning, some highly questionable transactions promise reduction of income subject to tax, deductions for personal expenses and reduced estate or gift taxes. Such trusts rarely deliver the tax benefits promised and are used primarily as a means of avoiding income tax liability and hiding assets from creditors, including the IRS.

IRS personnel have seen an increase in the improper use of private annuity trusts and foreign trusts to shift income and deduct personal expenses. As with other arrangements, taxpayers should seek the advice of a trusted professional before entering a trust arrangement.

One thing that's important to note:

Whenever a particular scheme makes it to the "Dirty Dozen" list, it is a certainty that Returns Processing has received specific instructions regarding intercepting these returns and forwarding them to Ogden. For those who are not familiar, Ogden is the national center for dealing with fraudulent returns.

... is very similar to the one released for 2012. Same old cons, and the IRS is including not merely scams for trying to cheat the IRS, but scams that try to steal from the taxpayers.

The "identification" of problem returns is not a perfect process. When the crazies misuse a specific code provision, this can create significant difficulties for the ordinary taxpayer who is correctly using the Code. For example, a few years ago, I had a client file whose returns correctly and appropriately claimed a refund under the section 1341 "claim of right" provisions. Because TP types were filing returns, asserting bizarre "claim of right" adjustments, my client's return went into a black hole (apparently it had been flagged as being potentially fraudulent). It took more than 18 months to get the return processed and the refund issued.

I missed the IRS release of the list for 2014.

The list is now dominated by identity theft, phishing, and other similar frauds, with a generic "frivolous arguments" at #9.

The misuse of Form 4852 (aka "CtC educated return") has fallen to #10, and is grouped with the 1099-OID scam. (The IRS is never very rigorous in its taxonomy.)

I should have also added that the IRS has updated the "Truth about Frivolous Tax Arguments" page.

I looked to see if there were any obvious additions, and there are a few court decisions from 2013 but nothing that stuck me as important.
