(a) The person is in a residential building as a trespasser having entered as a trespasser;
(b) The person knows or ought to know that he or she is a trespasser; and
(c) The person is living in the building or intends to live there for any period.
For the purpose of Section 144 a 'building' is defined to include any structure or part of a structure (including a temporary or moveable structure) and a building is 'residential' if it is designated or adapted, before the time of entry, for use as a place to live.
The penalty is up to six months in prison and/or up to a £5,000 fine.
It's arguable whether the rooftop occupants intend to live in the building, but the plan is to reinstate the Crawfords to live there. As squatters.
Is Mark being as sneaky as a snake?
Is he in or on the building?
Pedantics will probably be his defence when he faces the beak.
Well it looks like it 's all over for the banks. If the grand jury verdict wasn't enough, their high court writ awarding final victory to the Crawfords is the icing on the cake. Yes, the same writ as has been reproduced a couple of times above which orders the County Court to produce some documents means it's all over for the banks because there was never any warrant.
I have spoken to master mclpud at royal courts of justice many times. With many people. If the masters say its wrong and no due process of law then thats it. Game over. I hope the people who took tom and sues home have good liability insurance
