A warrant of possession is an instruction from the court to the enforcement officers. The validity of a possession warrant stands or falls according to the validity of the underlying possession order and notice of eviction. In that respect, it is quite different to a search warrant which is a standalone document and not reliant on previous court decisions.
I had a discussion about this issue yesterday with someone who works for our local Law Centre and Citizens Advice Bureau and specialises in debt issues including repossession due to mortgage arrears. He confirmed a couple of things for me:
1) Warrants of Possession are not signed by the judge since they are simply a confirmation that the Order of Possession can be enforced.

2) He had never heard of FMoTL etc so had not come across the claims about court seals etc. but in his experience seals are usually the "handstamp" variety without the date in the centre. He had no idea where our friends might have got their ideas about what a warrant should look like. In fact he can't think where the actual requirements might be specified because as he said it is effectively an internal court document.

3) Again in his experience,householders are not sent or shown the actual Warrant of Possession. They are sent a Notice of Eviction (N54) form. In his opinion someone who says that they have received a "warrant" (i.e. Tom) has almost certainly been sent this form and not the actual warrant.

4) He had never heard of Tom Crawford which I suggested he googled. I'll try to catch up with him again next week to see if he has any further opinions.

I don’t think it will be too hard for the prosecution to prove Mark Haining AKA Ceylon AKA SriLankerC who runs the web site Getoutofdebtfree.org was the instigator of this whole sad and sorry saga from the beginning.

This is a rallying call for people to attend “the event” of Crawford’s eviction attempt and billed as

He, along with Abdullah/Kak can be seen here telling Crawford the Bradford & Bingley had “tricked” Crawford into handing over power of attorney to B&B. And that B&B had made a “criminal” mistake made by people “high up who is probably a paedophile” and of course that old chestnut “corrupt judge”. And Crawford telling lies about the “changed mortgage” that wasn’t in fact changed at all as proven in Judge Godsmark’s verdict where both sides agreed “the mortgage had not been changed”.

There is so much information and evidence given by Mark Haining himself that should the prosecution need to point out a ‘ringleader’ Mark Haining Ceylon would be top of the list .
I don't doubt Mark Haining will be frantically attempting to delete anything that points to him having anything to do with it.
I can see Sycophant SalliNae on over time and working double shifts between now and August 10..

Tom and his struggles for justice have given me a new goal. The next time I go pubbing in Britain (been six times since 2002, over 1,000 different pubs) I'll make sure to include the Elwes Arms in our itinerary. My pubbing companion and I were discussing a return visit to Nottingham and that would fit right in. We've been to 28 different pubs in Nottingham, many now sadly gone, but never got around to Elwes.

Let's just say that the legalities of such a business raise a lot of questions. Plus I'm not convinced of the practicalities of picking a clamp lock, they aren't out of the Pound Shop. I'll consider starting his own thread if necessary but we may have to wait for the conclusion of the current trial.

Burnaby, I meant to post a bit back. Did I see you mention you were going drinking in Halifax next time you're over. If so, if you're fancying something a bit different there's a small independent steam brewery just out of halifax which has its own onsite pub. Shamefully, i've never actually been myself, but had it recommended.

I was meaning in the sense that such a large group of supporters may have a detrimental effect on the court. We wouldn't want to "accidentally" be mistaken for their supporters would we....

Probably not been to it if it is outside of town. Do you have a name? We tend to spend a lot of time in Lancashire. Hebden Bridge, Colne, Nelson (I know it's a dump) Burnley, Barrowford, Lancaster, Liverpool of course, great pubbing town. Even Blackpool.

In our 2011 trip we spent a night in Halifax and had a beer in these pubs;

Barum Top (Wetherspoons)
Old Post Office
Pump Room
Railway Hotel (spent the night here)
Ring “O” Bells
Three Pigeons

Three Pigeons was my favorite of the bunch. Barum Top by far the worst. Music so loud it was deafening.

I dunno, it comes on early sometimes. My younger son who is only 5 years out of university, won't frequent the same pubs he went to as a student because "you can't get a seat and the music's too loud to hold a proper conversation". I couldn't be prouder.

Picking a lock isn't that hard, I've done it myself (though not a Car Clamp one and it was a lock I owned), and car clamp locks generally are designed to be difficult to cut through. Picking them is usually the weakest point and easiest method of attack. You'd be surprised at how weak many 'expensive' locks actually are to picking attacks. The main issue with carrying a set of lock picks is that unless you are a locksmith, you don't have any good reason to carry them and it counts as going equipped.

The 49 at the end of my name is the year I was born. So you young callow punks can feel free to mock me. However the Barum Top was way too loud.
