Off topic, but if anyone remembers Catalog stores like Service Merchandise or Best Products, you used to visit the store, look at the displayed items from their catalog, fill in an order form, and they would send the item down from the warehouse, and call your name when it was ready to be paid for and picked up. As Yung'uns we would have hours of fun ordering stuff using funny names, just to hear them call them out over the PA, good times :)

The problem Tom has is that he didn't ask the enforcement agent for these while he was on the premises. By the time Tom had arrived the warrant had been enforced and his confrontation was in the Chase and technically not on the premises. It could also be argued that by the time Tom showed up the actual repossession had happened, this would have been when Sue was removed from the property with the assistance of the police. Tom came in too late to the party to do anything except watch the consequences of his choices.

Secondly even if a minor procedural rule hadn't been followed that doesn't render the entire eviction unlawful, it just means that rule wasn't followed. Tom could file a complaint against the enforcement officer, which would then be evaluated but this wouldn't override the courts ruling. It wouldn't make the possession unlawful because that failure, if it was a failure, had no bearing on the possession order.

The court ruled that UKAR were entitled to possession due to the failure of the Crawford's to pay their mortgage arrears. Nothing that happened in July will change that, it was decided long before they turned up and evicted him. He lost.

Entirely to brag but both the dogs I've had have been so well trained that I can leave Pizza in front of them and they won't touch it. The current one will even wait for me to tell her when she can eat a slice I put on the floor specifically for her.
