Re: "Ceylon" the UK's top Goodfer nothing
Since it was apparently the council that filed the petition would they even have to pay filing fees and deposit?
I suspect this is what would be called an "involuntary" bankruptcy here, but as a rule I don't think gov't entities get involved. They would just have a tax lien and sell the property at a tax sale to recover what was owed. Over and done with. You have a certain period of time to redeem the property or else it is gone.

The bankruptcy can be annulled if someone pays the debt and fees for him. He will have to go to court again to progress this.ArthurWankspittle wrote:Yes, great little twist to using bankruptcy to get your money. Do you know if he gets someone to pay the debt that he can ask for the petition to be withdrawn or is he now royally screwed? I suspect the second, and he has to go through the whole process now that it has started.guilty wrote:Yes, and unless he can persuade someone to pay off his debt to the Council (he now can't use his own assets for this, because he's bankrupt) his home is at risk.

It is now the official receiver's job to obtain payment of the debt and fees. Any of your assets can be used for this, including your house. The Council is not involved.notorial dissent wrote:

If payment under the petition (the Council Tax debt) is secured from a third party then section 282(1)(b) of the Insolvency Act 1986 applies and the official receiver would send notice to the court confirming the payment. (He would also comment upon the defendants conduct during the period ) This does not release the defendant from any other debts that he may have.

I think they would have to pay the usual fees. Council Tax in the UK has its own rules and status. Getting the equivalent of a lien (a "charge" in England and Wales I think) both involves more work and therefore cost and you can end up with a charge but no enforcement, so the charge just sits there until the house is sold. Which would suit some people anyway. As has been pointed out with Tom Crawford, bankruptcy is the way to go, you pay the fees then it is out of your hands. Eventually the receiver will come back and say here's some money or there isn't any money. Either way, no further cost to the petitioner.notorial dissent wrote:Since it was apparently the council that filed the petition would they even have to pay filing fees and deposit?

I don't think England has the concept of "involuntary" or "voluntary" bankruptcy, it is just bankruptcy but anyone can petition for it, including the debtor.

One of the major differences between the UK and here, on a tax debt, i.e. council tax, they would have a tax lien and when it wasn't paid for a specified period of time, then they simply issue notice and sell it for taxes, and if it isn't redeemed then whoever bought the lien gets the property. Nasty but effective. Might be a bit more complicated in UK since the tax is personal rather than based on the property.

What most people don't seem to understand about Charging Orders is that the debts on them are still subject to interest after the charge has been imposed.ArthurWankspittle wrote:I think they would have to pay the usual fees. If it's a debt under the Consumer Credit Act it's charged at 'business' interest (ie the interest rate of the loan or credit card - God help you if it's a payday loan !!).
If it's a debt such as Council Tax it's Statutory Interest (aka County Courts interest) which is calculated at the rate of 8% per day, so if left for long periods of time can double or triple the initial amount owed.

Sounds like they get you coming and going on that one, and the idiots just contribute to that.

Sorry, what I meant was it's calculated for everyday you owe,Pox wrote:I thought it was 8 per cent per annum?AndyPandy wrote:

so If you were owed £10000
the annual interest would be £800 (10000 x 0.08 = 800)
you’d divide £800 by 365 to get the daily interest: about £2.22p a day (800 / 365 = 2.22)
after 50 days this would be £111 (50 x 2.22 = 111)
Leave it 10 years you'd owe £18k

What has happened to Sack and Crack ?
Has the ponytailed one had a lovers tiff, with his chubby bald significant other ?
Have they been banned from the graveyard for filming their "get togethers" ?
Have all their failures started to take their toll on Dumb and Dumber ?
We will all have to wait to find out on the next exciting episode of "lets talk b******'s"

Emperor goof Mark ceylon Haining has just posted a piece from the Law Society Gazzette which has a quote from Michael Gove
It will be the likes of Mark Haining Ceylon , Ebert, Crawford and Taylor who would be the cause of our justice system moving at "Victorian speed".
He should be pleased.
http://www.lawgazette.co.uk/analysis/co ... GAZ-230915Michael Gove has described the courts as ‘creaking and dysfunctional’ and compared the speed of justice to that of Victorian times. He may be right.

He has written a dictionary and doesn't understand the use of comma's or when to use a capital letter. Jeez the introduction to the dictionary, doesn't even make sense and reads like it was written by a 5 year old. Cheeky git, wants to charge people for this
"and simply to get You to speed," ?????????????????
"thank you 2 successful donators who helped i get this published" ????????????
"and so helping my kids (when they get older) they don't have to have the same painful confusions problems again" ????

"Discharged" is an interesting word. Do we know what really happened?

Discussed earlier, possibly in this thread. I'd hate to think anyone was breaching their bail conditions in that picture.....(I genuinely don't know.)Hercule Parrot wrote:"Discharged" is an interesting word. Do we know what really happened?

Burglars are people that break into houses. That's exactly what Haining did at Tom's old place is it not?

Now that ol Tom is on the scrapheap & no videos of himself with significant baldy other half surfacing, he's planned what appears to be a protest this Saturday in Nottingham. Yes, you've guessed it, Paedophilia. There's an event in the City apparently which no doubt Haining , megaphone Micky & idiots in hoodies & masks will jeopardise.

No, this is just one of them " an arrest is imminent" videos that Haining posts when is feeling unnoticed and forgotten. There is a goose fair on though, so Haining can say it was a great turn out they had at the pedophile protest where in reality only two turned up....Micky Summers and Mark Haining ceylon..

Nottingham Council are setting up as energy suppliers as an alternative to the big boys.
It's called "Robin Hood" energy. I can see that causing uproar amongst the lunatics
