Every so often, one sees an appeals court decision that, while innocuous in its text, seems to bob slightly in the legal ocean in a way that suggests a grand and glorious mountain of woo beneath the surface -- the tip of the derp iceberg, as it were.

And so it is with Case No. 15-2174 in the Third Circuit Court of Appeals. If one reads the body of the opinion, it's nothing that out of the ordinary, and in fact sadly common. To summarize: 'we have here a pro se habeas petition, which doesn't identify precisely what it's attempting to challenge, but that was filed in the wrong jurisdiction, and which seems to lack merit in any case. Affirmed.' Boring.

It's in the caption of this particular petition that one can see the furious undercurrent of derp:

I couldn't help myself. I had to know. With excited trepidation I went to PACER for the US District Court for New Jersey, pulled up Case 1-15-cv-01869, saw the 61-page petition, warily clicked "Download"...

Dear diary: Jackpot.

I cannot hope to adequately summarize this document. One must experience it for oneself. But beware, for if you gaze into the derp, the derp gazes also into you.

Nevertheless, I will suggest a few highlights:

• Page 4: A helpful chart outlining the differences between "The Contintental united States of America" (apparently also "Republicans") and "The Federal United States" ("Democrats = Socialists = Communism").
• Page 5: Oh sweet $DEITY. The caption didn't even begin to cover this.
• Page 6: And we're off and running. "I, Prophet H.J. Foy... am a sovereign, sui juris, free[REDACTED]man, a follower of Yahshua the Messiah in the laws of The Almight Supreme Creator, Yahvah first and foremost and the laws of man when they are not in conflict (Leviticus 18:3,4). Pursuant to Matthew 5:33-37 and James 5:12, let my yea be yea, and my nay be nay, as supported by your Federal Public Law 97-280, 96 Stat. 1211. Whatever's been going on, it's been going on for a while. There's another habeas petition from the Southern Division of the US District Court for the Western District of Missouri that was dismissed back in 2010; another one that was dismissed in 2011; and a 1983 complaint filed in the US District Court for the District of Columbia that was dismissed in 2011.

Foy has not had any pending criminal charges since 2007 - they were dismissed because he was incompetent. Since then he has been civilly committed. He could have walked out in 2010 by simply agreeing to certain conditions, such as attending counseling sessions and taking meds. He has refused to abide by any conditions at all. He is therefore still committed, and filing various actions on a monthly basis. The likely reason he has not been declared a vexatious litigant is that he is still being held against his will, and has a clear right to challenge that. For the last five years.

Whatever else he may be, Foy is obviously nuts.

It's a disturbing example of what can befall a mentally-disturbed person, to say the least.

Perhaps any number of people are safer because of his being held, but I know there are what seem to be equally disturbed individuals who live in homeless camps, on the streets or in shelters.

And it's broken in pretty much the opposite way to how it used to be broken.

It used to be that people with mental illnesses were shovelled into institutions, medicated to the gills, and forgotten about. The eventual public backlash against that was so strong that now it's almost impossible to involuntarily commit someone for any length of time, unless they're a physical danger to themselves or someone else -- a very high standard to meet, and folks often don't bother trying. So people bounce back and forth between the streets, jails, and temporary commitments -- unless and until they end up in a serious criminal situation. Then they often get caught in the land of 'incompetent to stand trial, too dangerous to be released without medication, but just competent enough to refuse medication.'

Not to delve too far in to psychology, BUT..... Mr Foy is far beyond that statement. What he is exhibiting is a type of severe psychosis that can maybe be treated and maybe not, but he is truly living in a terrible fantasy world, literally of his own making, and it will only gets worse. He certainly deserves concern and compassion, and treatment, whether he will get either or both is an open ended question.
