I had an email from Npower about changes to the terms and conditions looks like Peter has had a small effect.

Taken from Payment (Clause 13)
We have clarified that we’ll only accept certain payment methods. If paying by cheque it must be in a form accepted by the UK banking industry and it will only be accepted in payment of a bill once it has been cleared by our bank.

My Christmas has already been made perfect. Nothing Santa could bring can top the gift I was just given at my local Lidl.

I was stocking up on Mini Butter Stollens and other goodies, queueing patiently at the checkout, when there was a ruckus at the next till over.

"I'm sorry, sir, we don't accept cheques."

"But you have to accept my cheque, it's legal tender!"

"I'm sorry, sir, we've never accepted cheques. Do you have a debit or credit card you'd like to pay with instead?"

"BUT THIS IS LEGAL TENDER! YOU ARE LAWFULLY OBLIGED TO ACCEPT IT IN SETTLEMENT OF MY DEBT. BY REFUSING MY CHEQUE YOU ARE IN DISHONOUR AND THE DEBT IS NOW PAID IN FULL!"

The manager came over and as the cheque was handed to him by the cashier I got a look at it. Sure enough, it was a WeRe Bank cheque.

Without success (as he was talking to the human equivalent of a brick wall) the manager tried to explain that cheques aren't legal tender and Lidl doesn't accept them anyway. At one point he referred to the man as "Mr [surname]".

"My name is copyright! How did you find out my name?" demanded the angry customer.

"Because it's written on your cheque", replied the manager.

"By using my name, you've agreed to pay me damages of £10,000, which I will accept in cash, right now!"

The ranting continued while I was going through my checkout, much to the amusement of both customers and staff. As I was handing over my payment, security arrived to escort the unhappy customer off the premises, while some poor sod had the job of putting all his shopping back (which looked to consist mostly of beer and bog roll).

I took the opportunity of having a quick word with the manager before I left to clue him in on FOTL and WeRe Bank. He'd never heard of either before, but said Lidl has never taken cheques so even if it had been from Coutts it would've been refused.

The customer looked to be in his 60s, not very bright (obviously) but bolshie and argumentative, trying to make a win out of an abject failure.

This buffoon could not be more wrong. A shopkeeper can refuse legal tender. A shopkeeper is not obliged to sell you anything. When you present a payment at the till that is an offer. The shopkeeper can refuse to accept your offer.

I'm sure if we ask nicely we might be able to get Lidl to share their security footage. To raise awareness of this con and to prevent similar frauds at other retailers during this festive period.

Having thought about this, it would seem to me that this is another poor mentally challenged soul - possibly with an underlying mental illness, who has been thoroughly taken advantage of by Peter. He will have paid good money for those cheques (Peter won't accept anything less after all), will now be banned from Lidl, and may well have seen his Christmas plans go to pot.

I'd also make the point that when buying something in a shop you don't normally enter into debt (unless the purchase involves a credit agreement), as far as I understand it, you take the goods to the cashier, they then make an offer of a price for you to purchase, if you accept this price and offer payment, then the goods are exchanged. At any point either party can cancel the transaction. A shop does not need to sell YOU anything, even though a shops main purpose is to sell you everything.

That is not quite right. The price is not an offer, it is an invitation to treat. The offer is made by the purchaser when they offer payment at the till. Acceptance of the offer happens when the shopkeeper takes the payment. Fisher v Bell [1961] 1 QB 394
