How I imagine this "recpature" bit going down:

JUDGE: Very well, Mr. Crawford, the court accepts your argument that there is an inherent right to recapture property that has been wrongly taken.

CRAWFORDS: (cheering)

JUDGE: And since you wrongly deprived Bradford & Bingley of their property by not paying for it as agreed, this court affirms all prior rulings evicting you from Fearn Chase. Case dismissed.

Recapture Law still exists, only now it's called repossession, order granted to the 'wronged' party Bradford & Bingley.

Getting back to the subject matter, has Tom been charged yet? It's been a week. Have we got boots on the ground tracking this?

The police can't charge much these days except for very minor offences without the nod from the CPS. They'd certainly have to get a sign off for a burglary.

I'm betting he wandered into the nick as arranged, was interviewed and then bailed.

The cops could (once again) impose bail conditions on the silly old sod such as stay off the roof - of any property, there's a good chap - and of course away from Fearn Chase.

Give him a nice long bail date and the can is again kicked down the road - for the time being anyway.

Meanwhile Toms fate lies with the CPS (couldn't prosecute satan) so what their eventual decision might be is anyone's guess.

I'd go for a Breach of the Peace, a nice Common Law matter.

So after following this story from the second eviction in Jan and I still find it hard to comprehend how grown men and women can be so deluded.
Now if he gets his day in the crown court and of course he will lose, he will make a video stating that the CPS used a judge who specialises in covering up fraud and corruption of the banks. He would also state that they used some sort of shadow, special ops jury made up of agents and infiltrators.
And of course if he just gets an ASBO and a ban from going anywhere near Fearn Chase it will be proof that there is no warrant
