I started this new thread on the continuing adventures of the privatesectoract.com crew simply because of personnel changes and a new business for them. I suppose this post should rather be entitled “It's Hard to Keep a Good Scammer Down”. With Ty Griffiths and his crew in disarray there was a hiatus for a few months during the summer:
1. Ty Griffiths has abandoned ship entirely, and except for the occasional peaceness and light posting to facebook, he is absent from the scene;
2. Kevin Kumar and Laurel Cinnamon are on the run with a Canada wide warrant out for him;
3. Allyson Johnson is still peddling health foods, the status of her fines is unknown;
4. Kevin Manji is now a restaurant worker;
5. Derek Johnson spent two months in Lethbridge Jail, apparantly his stay was rather un-nerving for him from reports received.

Before his June 7 rather disastrous court proceedings, Derek indicated publicly that he was giving up on the real estate business and planned to branch out into something new.

edit: for those of you who haven't been following the very lengthy saga of the crew, their previous real estate schemes were peddled under the Real Estate Council of Canada and Commission Free Systems (now dead links by court order.
Earlier versions of the site also had a page devoted to the typical OPCA redemptionist argument of redeeming your birth bond through Fidelity Investments but I neglected to save a copy.
As further proof, this business scheme is being peddled widely on kijiji by one of their former employees, Keith Moro, who through front companies like Beryl Investments and Kyanite Investments was active in commissionfreesystems. Here's a backgrounder on Keith Moro:

My, but that's a mouthful of utter nonsense.

I can't help thinking that somewhere buried in that morass there is an offer to sell unlicensed securities or some such that should set off some alarm bells somewhere.

I think this particular kind of stupid is incurable and can only be dealt with by a sizable prison term for all concerned. Still reeks of scam.
The fact that you sincerely and wholeheartedly believe that the “Law of Gravity” is unconstitutional and a violation of your sovereign rights, does not absolve you of adherence to it.

There whole website approach seems to be based on the fact that if you throw enough important sounding words at the victim they will be enticed into joining the scam. They get incredibly detailed in some respects as to which email to send, demands for wet ink signatures etc, but they gloss over other important details. I will detail it all in the next few days, but it's really nothing more than their old real estate scam of reselling foreclosed properties recycled into the buying and selling of debt contracts under the guise of being helpful guys aiding in debt consolidation for the unfortunate.

My excuse for the tardy responses - renovating my humble abode, tearing up sub floors, and things are not going well so I needed a beer and caught your response.

As promised, pretty well a month ago, here are some updates on Derek and Kumar's latest business venture. I must admit to having a few difficulties initially figuring out how it all worked, but it's now displayed for all the world to see. It is exactly the same as their previous real estate scam, but with a different product. Even the lower level tactics of advertising on kijiji, recruitment of front line employees, etc are following the same format. Although the lower level tactics are perhaps potentially more humorous, I will leave that to a later post.

In their previous real estate scam, it was actually a two part scam that evolved over a period of years and you had to do some digging. They obtained fraudulent control of properties that were either under foreclosure or for sale by owner. They then accepted deposits on these properties and explained away the delay in completing the final transfer with the excuse of waiting for conveyancing. If you really searched hard you could find some excuses, on youtube, that they were “auditing” any liens or mortgages on the properties. Of course, any deposits paid by unsuspecting victim #2 simply disappeared.

Their latest scam follows exactly the same profile and methodology, except that the product they are selling are unsecured debt contracts. They have been careful to delve into this largely unregulated (in Canada) business. It's all laid out on their web site now, no need to follow them on youtube or facebook. The first step is convincing some poor sod that they can handle all their money woes by lending them money through a private investor through a debt consolidation loan.

As part of the justification for this fantastic deal, along with using simple rather than compound interest, they claim they can reduce the total amount owed by the old freeman tactic of auditing the loan, wet ink signatures, etc.

In fact, they even include a handy pro-forma copy of a letter to send to your creditors.

Now that they have victim number one on the hook so to speak by arranging a debt contract, the next step is to resell that debt contract to victim number two, which is where the scammers' real profit lays.

Victim number two is convinced that this is a great proposition since he now has a creditor who is paying off a loan for X dollars that has really been discounted by whatever percentage through the magic of auditing the loan.

It all sounds great, but of course this loan auditing is nothing more than a delaying tactic while they enjoy the deposit the lender has paid them. Here is the fine print on the deal...

As mentioned previously, one of their front line workers peddling their debt consolidation schemes is a chap called Keith Moro. Here is a picture of Keith taken from his facebook page.

Here is the profile picture of a chap called Angelo Alexander, selling exactly the same debt consolidation product on kijiji. The email address from kijiji is the same as Moro's but the phone number is different.

Perhaps Moro and Alexander should get together and establish common grounds as to who is using who else's image in vain, since Angelo claims not to have never heard of Keith, Kevin, or Derek. No change from their previous real estate ventures, constantly shifting (false) contact names.

Our friends have taken time out from auditing loans to get great deals for their customers and perused Quatloos and are more than a little upset with what has been said about them. In their previous life they would have been posting videos on youtube linked to by Ty Griffiths or even gone all FMOTL with their Alberta Court of King's Bench. Although they claim to have a crack legal team on contingency to handle these problems:

I've been out of the loop for the last three weeks because of knee surgery but I finally roused myself from my drug induced somnolence to resume posting. So, what have our friends been up to? A few ads on kijiji for debt consolidation services. They're being very careful now about hiding their links to the Private Funding Investors Network so their marketing must be taking a hit - all that effort to create a web site and they don't even link to it any more.

Almost exactly the same as their previous site, just a different name. At first I thought this was just them following their usual business model of multiple web sites, but maybe there is a simpler reason - no web site administrator. :shrug:

Apparantly Kumar was picked up late the previous week, spent a few days in remand while his new digs were being prepared for him and was transferred to a Correctional Center to begin his Christmas vacation on 21 November. For those of you who wish to send him Christmas gifts or cards he's in the Spy Hill Jail in Calgary. (wondering if he would accept visits from members of Quatloos) :snicker:
Some investigators have had interviews with him and they most definitely have my sympathies. His responses range from "didn't do it" to Ty Griffiths in full Hot Justice Reality TV mode to "we're not guilty because everybody ran away from their contracts so we never made much money".

I'm making my post here rather than the old privatesectoract.com thread simply because according to my doctor I am to limit my time on the computer. Getting the personal stuff away, my eye surgery was moved up to last Friday, everything went very well, thank you to the best wishes from fellow quatloosians. I only have to do the face down thing at night and the only problem is that I have this damn gas bubble that has been injected in my eye that makes it appear that I am swimming. Really officer, that's my excuse for stumbling and bumping into things, it's not the beer.

Anyways, back on topic.... Derek and Kevin for the past year or so have been continuing their debt consolidation games but otherwise have been very quiet. They have been careful to disguise who is actually posting their kijiji ads by using a series of "front-people" (BTW, their favorite protoge, Keith Moro, has died) and requesting phone numbers before any contact. Pretty boring actually so I only have been monitoring their activities a couple of times a month.

One of the comments that continued to come up on the old privatesectoract.com thread was "why haven't they been charged with criminal fraud?". Well here is what I found last week:

This reference gives a good explanation of the crime of fraud in Canada. It looks like they are facing a 2 year minimum by my interpretation.

August 2015 was when the pair were at their height: hijacking ads from other people, threatening various members of the Group of 15++, and generally acting as if no-one could touch them. I'm trying to find out more information about which of their many instance of fraud the Crown cherry picked for the case. Although I'm free at the time I probably won't attend their arraignment hearing to mock them, something about my blue bracelet that won't let me on an airplane or travel through the mountains or my eyeball might explode. :shock:

I can explain the abbreviations.

AHR - Arraignment - Used when the anticipated event is an arraignment before an adjudicator.

SBD - Scheduled (Defence/Accused) - Used when an accused is scheduled by a Judicial Case Manager to another appearance as requested by the Defence/Accused.

CLC - To Consult Counsel, Used when an accused has been adjourned to another date to consult with counsel (See CCFM Rule 8(2)(g))

FAW - First Appearance Warrant/Police Release - Used after the execution of a warrant where the accused has been released by the police and the accused is making a first appearance in accordance with that release document (not in-custody).To be added in future.

As I mentioned previously I was wondering about which instances of fraud the Crown was going to cherry pick:
Kelowna resident Shelli Cohen says she came into contact with Johnson and Kumar after she responded to advertisements placed on Kijiji.ca in 2015.

"They basically called it creative real estate or creative financing, in which their goal was to find people who were selling their homes privately and connect them with buyers that could not qualify for conventional mortgages and then they would use investors that would facilitate a transaction," Cohen said.

Cohen said at first she trained with Johnson and Kumar and eventually invested $12,500 in a home purchase brokered by the pair.
The all-seeing eye of the Group of 15+ knows about the Shelli Cohen deal. One thing the Crown has to prove in a fraud case is intent or in other words that the perpetrators should have known or did know that it was a scam. This one was pretty blatant from what I hear. Derek and Kumar hijacked an ad from an unaware home seller and took Cohen's money as a down payment for the house that was in the process of being legally sold to someone else entirely. Roughly the same as me picking a vehicle at random off a dealer's lot and selling it myself to some guy and pocketing the money.

Derek and Kumar's preliminary inquiry is on Monday with trial continuation on Tuesday. I'm nursing a bum knee so out of boredom I have convinced my wife to run me over to Kelowna to attend. Should I be the kindly old gent with a cane or the mean old coot with a stick? Just for interest's sake they have even brought in a Crown out of Vancouver to prosecute it. I wasn't aware that BC had a group known as the Office of The Commercial Crimes Crown Counsel with special expertise in fraud related matters.

Not really, Kumar asked for and got a publication ban and no witness contact order. About all I am allowed to say is that they have split the trail again - Kumar has a BC Supreme Court Judge and Jury trial probably on the 15 th of October. Derek started the proceedings today by asking that his trial be moved to Winnipeg under the jurisdiction of a provincial judge at a date yet to be determined so he got to miss today's fun.
Sorry, that's it at least until Kumar's trial is over

Publication bans on a Preliminary Inquiry when there is a Supreme Court jury trial coming up are pretty well the standard in Canada.
Section 539 - An order under this section bans publication of evidence taken at a preliminary inquiry until the accused has been discharged or, if ordered to stand trial, the trial has ended. In cases where a file is transferred from the Provincial Court to the Supreme Court for the purposes of trial, the ban remains in force until the trial has ended. However, the ban does not apply to any evidence given during the trial.

I'm not sure which combination of the two individual trials I shall attend. Winnipeg from here means flying and my motivation for driving through the Kicking Horse and Rogers Pass route in early winter to Kelowna is limited. - Just got back from Kelowna and in good weather it took me 9 hours. That all being said it was rather enjoyable to throw our pair off their game when they saw me. I was debating greeting Kumar with a cheerful "Good morning Ty Griffiths" but was dissuaded by my wife.

Talking about grinding them down - they must be incurring some legal bills so there is a new business venture afoot for them which I will report on tomorrow. Here's a quick summary of their case(s) right now: (this is from a redacted email I sent to an interested party so it's a little disjointed)
Originally the indictment was written so that Kumar and Johnson were to be tried together. In the Canadian court system, it'snot like what you see on television. All the evidence that the Crown plans to use has to be revealed to the defence and a summary of it, along with witnesses, is presented during the preliminary inquiry. A preliminary inquiry can be interesting since it can give hints to both opposing sides what the strategies for the trial are going to be.

So here is what happened with Kumar and Johnson: (checking back in publicly available Court documents not subject to the ban)
1. Johnson's trail was severed from Kumar's, Johnson will be tried in Manitoba Provincial Court
2. During the prelim Kumar's lawyer made it a little too obvious what strategy he was going to follow. IMHO :shrug:
3. On 2 October there was a court appearance to schedule another court appearance;
4. On 9 October the Crown had what is basicly a freebie retry. They added in more evidence/witnesses so that there was sufficient information to rewrite the charges for Kumar acting on his own. It's known in Canada as a Proceeding under New Indictment. You will notice that the file number has changed from 87425-1 to 87425-2. Both fraud charges still stand, the Crown has just changed the way they are going to present their case.
5. So now the whole thing for Kumar will restart again in April on the 19th with a pretrial conference.

Interestingly enough I was recently talking to someone with expertise on the matter and used the phrase "a race to trial". I'm being careful not to say too much because of the publication ban but it's a standard legal tactic when there are multiple persons charged with two or more offenses. The first person to come to trial mounts some sort of defence on one of the charges but blames everything else on the other guy on the rest of the charges.

More to the point, because of the publication ban, and because Kumar et al, were trying to be good boys before trial my life had become incredibly boring. No more coming home after work on Wednesday to check out Ty Griffith's weekly rant about me:

In its first version it was an almost exact word for word copy, just some grammatical errors cleaned up, of the PrivateFundingInvestorsNetwork site. This is just a teaser, I will talk about the scam's "improvement" and new personalities involved in my next post. I guess Kumar just couldn't stay away from OPCA schemes. I'm even safe from the publication ban part of things because none of this can be linked to what he is on trial for now so long as I am careful not to talk about his real estate ventures.
