R. v. Barens, 2016 BCCA 389[3] Mr. Justice Savage described the case and the issues Mr. Barens seeks to raise on appeal. I cannot say he was wrong in his appreciation of the issue sought to be raised by Mr. Barens. In a nutshell, Mr. Barens says he is not required to have a drivers licence because he is a human being, and not a person as referred to in the licensing requirement of the Motor Vehicle Act. He relies upon the International Covenant on Civil and Political Rights as allowing him free movement as a driver without being licenced. His proposition is, I must say, what is described in law as a frivolous argument.

Norris had been convicted of driving without a licence contrary to s. 24(1) of the Motor Vehicle Act, R.S.B.C. 1996 c. 318. This is his offense;
Oddly I can't find any record of his conviction in B.C. Courts Online;24 (1) Except when accompanied by a person authorized by the Insurance Corporation of British Columbia to examine persons as to their ability to drive and operate motor vehicles, a person must not drive or operate a motor vehicle on a highway unless, in addition to any licence or permit which he or she is otherwise required to hold under this Act, the person holds a subsisting driver's licence issued to him or her under this Act of a class appropriate to the category of motor vehicle driven or operated by him or her.
(2) A person who contravenes subsection (1) commits an offence.

All I can find is a 2003 conviction for failure or refusal to provide a sample, probably a breathalizer test, and a 2010 conviction for speeding.
He appealed this conviction and lost. So he tried again but the Provincial Court would not allow him a second shot at it. So he tried at the British Columbia Court of Appeal who gave him very short shift;
But Norris is right! The Motor Vehicles Act does not define "person", leaving it wide open who the Act requires to have a license. It could be referring anyone![5] It is to be remembered that an appeal expends the resources of the community, not just of the Crown who is put to the task of responding, but also of the court which has an obligation to use resources efficiently, remembering that people wait for court dates and should not be put further behind by appeals requiring leave that have no chance of success.

However, although he promised to keep everyone informed about how his appeal went, he somehow neglected to mention that he'd lost it.
I have been filing my Notice of Appeal to the B.C. court of Appeal on my right to travel public highways, I will be keeping everyone up to date.

In 2008 he actually ran as a candidate in Vancouver Quadra, a very affluent riding which includes the University of British Columbia, my old alma mater. He quite predictably did extremely poor in this riding, essentially a sacrificial goat, getting about a half of one percent of the vote. I suppose he could take comfort that 332 people thought he was worth electing.

Basically an obsessive whine about getting a ticket for parking in front of his own house. Tough, get over it, we've all been there (at least I have). But he's special! He works so hard and is so dedicated;
If you want the whole saga it's hereIn May 2005 I notice a parking ticket on my motor home for $100.00 the ticket said that I was guilty of parking a large vehicle for more than 3 hours abutting private residents. Ok I am choked. You see I work in the movie industry as a first aid attendant and work long hours I have to park my motor home in front of my house so I can have time to sleep before my next shift. This compelled me to do research on my parking ticket. What I found was so disturbing it caused me to seriously question the political system in which I live. I am now determined to expose the crime of Treason that was perpetrated on the citizens of Vancouver and the abuse of the Canadian political system as a whole.
For my job in the movie industry I require a motor home because my job entails carrying supplies for cooking soups and various other snacks such as pop, candies, sandwich meats. Dips, cups, bowls and so on as well as cooking and serving equipment to serve the cast and crew as well as carrying my stock of first aid equipment. As you can imagine this requires a great deal of space packing around enough food for a hundred plus people.

This is significant if the highways are privately owned then what gives the government the right to tell me I can’t park in front of my own house because of the shape and description of my vehicle?I remembered that after reading the above mentioned article from England that I lookedup the Municipal Act of 1996 under the heading possession of Municipal roads section533 that the highways were owned by the municipality
(except for any rights in the“soil” that were reserved by those that built and dedicated the highways). What werethese rights? Highways were built by land developers; a right of easement was thengranted to the public to pass and repass over the highways and were to be maintained at public expense. As you will see later the rights that were reserved were the rights of estate. The highways in 1996 were private property here in B.C.

The issue, as I read it, is some problem with his inheritance from his father. I'm guessing that he thinks his sister screwed him out of it. Since a petty squabble about not getting enough of dad's estate isn't promising material as a Noble Cause he claimed that the real issue was elder care abuse of his father and he placed $15,000,000 of what he called Common Law Liens on his sister and some nursing homes. In essence the unilateral contract 3/5 letter scheme that worked so well for Allen Boisjoli. After they'd been "perfected" because nobody bothered to reply to his bullshit demands, he decided. for some crazy reason, to sell them for $600,000, just 4% of their face value. And you Americans think you get bargains on Black Friday!
But you have to ask yourself, if he'd perfected them why sell them for a pittance? Why not collect the entire fifteen mil himself? And this was 2010 and he still seems to be driving that food truck around between filming locations. Why, if he's collected $15,000,000 or sold the lien for $600,000? He's probably too busy doing his bit to make Vancouver the film capital of the world to get around to collecting the money. He takes his responsibilities seriously.
