I think so. High Court and amount involved I think makes it likely.Hercule Parrot wrote:Incidentally, does the normal 8% interest apply to the £72,000 costs order?

I agree. Even when they are proven to be wrong they refuse to see it. Losing a house or going to jail only strengthens their belief that they are right.JimUk1 wrote:

Nowadays I find it amusing when everything comes tumbling down around them.

Now I understand a great deal more about all this, and the bill for costs makes a good deal of sense. If they had to replace the stones, which I didn't understand what they were until now, that IS NOT a cheap process, a great deal of time and expense for something that should never have happened in the first place. The woman is a stupid menace, and really needs to go to jail for a while.

I need the "Yeah That" smilie off the Fogbow or a "Like" button. Although it has its problems, the planning rules that stop people doing what they feel like to old buildings are generally accepted and respected. Also, people with the skill to do this sort of work aren't cheap. This all comes back to a "you're not the boss of me" attitude by the homeowner and, as often eventually happens, it catches up with them and costs them.notorial dissent wrote:Now I understand a great deal more about all this, and the bill for costs makes a good deal of sense. Re: Rekha Patel loses her house
Rekha Patel paid the neighbour £8k damages two years ago and paid a further £8.5k for Appeal costs. It's the lawyers fees over 6 years that come to £72k. Ms Patel has lost a trial and two High Court Appeals. She was a litigant-in-person throughout, either because no solicitor would represent her or because she knew she was "right". Add to that the cost of the court order for sale of her house, the eviction last summer, the recent court injunction, plus interest. . .legal fees don't come cheap, she must owe well over £100k by now.

So the £72k was for the neighbor's lawyers to get Patel to pay for the damage done to the neighbor's property. Still something she brought on herself though and she still owes it, and undoubtedly more by now after all this.

From what I understand the issue of the property damage was settled a couple of years ago. The bulk of the 72k she owes stems from a string of vexious litigant in person law suits she launched against the neighbours for having the audacity to sue her for damaging their house.notorial dissent wrote:So the £72k was for the neighbor's lawyers to get Patel to pay for the damage done to the neighbor's property. From EFOTB
Rekha Patel
2 hrs
Friends please share my post, today. The land registry updated my deeds to Patel Cottage, 81 Simmondley Village and on 25th Nov 2016 I am the sole owner of my property. So I phoned the council to tell them to change it back to Patel Cottage, Simmondley Village as there was their proof of my ownership. The man said the legal person isn't in today you will have to wait until Monday. I have just checked the postcode for my address and it has been changed to Hanover Cottage, 81 Simmondley Village exactly what it says on the injunction stuck to my door, it was just 81 last time I posted a couple of days ago, ready for these private thugs. I have phoned the police and they told me just to have my deeds ready to show, they have obtained a writ of restitution by deception, writ of restitution allows reasonable force to remove trespassers, I cannot be a trespasser when I am the outright owner with no mortgage and title absolute. I am going to have to start a petition of some sort but my head is in bits any ideas of who and what...I have tried to get an emergency hearing from the court last tuesday but I'm still waiting.....

I hadn't understood that to begin with, I was sure that there was a heaping helping of lawyer's fees, there always is in something like this, but I just figured she'd skipped out on all of it. Doesn't alter that she she has damaged the neighbor, by actually physically damaging her property, and then by costing her the money to get Patel to fix it.daltontrumbno wrote:From what I understand the issue of the property damage was settled a couple of years ago. Looks like Patel is looking to add on some more legal fees when they get around to tossing her out this next time and getting the land registry back to where it is supposed to be, maybe they can add a criminal fraud charge when they lock her up this time.

She thinks that changing the name of the house will invalidate the writ which references the old name. Does she think they're that stupid?Firthy2002 wrote:So she fraudulently gave false info to the Land Registry?

Unfortunately she may be right in that hope. If Police are called to an ugly repossession / eviction incident and someone points out an apparent error in the legal paperwork, they are likely to advise the bailiffs to withdraw and come back with everything corrected. This is why we see the crowds of internet lawyers at such incidents, urgently blathering about "wet ink signatures" and embossed seals etc. If they can create a reasonable doubt in that constable's mind, then they win the day.aesmith wrote:She thinks that changing the name of the house will invalidate the writ which references the old name. It would seem sensible for the bailiff/claimant/court to send a copy of the order to Police legal dept in advance, explain and clarify any questions. Surprised that this doesn't happen more often.

I don't think the thickest plod would fall for Patel Cottage 81 Simmondley etc. not being 81 Simmondley etc.Hercule Parrot wrote:Unfortunately she may be right in that hope. Going back to cost, I can see that a lot of the £72k is going to be legal fees now. Getting what was probably a barrister or two with specialist knowledge of the areas concerned (building and boundary law, and defamation / false legal claims) will cost hundreds if not 4 figures PER HOUR for the expertise concerned.

Re: Rekha Patel loses her house
Trouble with the Land Registry is that the Registered Owner on the Title Deeds doesn't get changed until the property is sold. So Rekha Patel can happily show Plod her name on the deeds and, not being au fait with civil law, he takes one look and walks away like he did last summer when she broke back into Patel/Hanover Cottage.

Re: Rekha Patel loses her house
It depends on what the bailiffs or High Court officials bring along with them.He Who Knows wrote:Trouble with the Land Registry is that the Registered Owner on the Title Deeds doesn't get changed until the property is sold. They've had some sort of writ of possession in the past which resulted in her being kicked out, only for her to break back in.
So it'll probably be an order from the High Court next time and obstructing/intimidating/threatening those bearing such orders won't end well.
This isn't going to go away and I expect the property will be secured with a bit more than some old plywood next time. There's a pub near me where the landlord had been kicked out, boarded with wood, he got back in so the bailiffs returned and it now looks like the Alamo with steel shutters and a big metal door which would take some getting past.
I think Rekha knows this which is why she's back on EFOTB trying to drum up a mob.
Another slow-motion car crash here.

She'll follow in Tom Crawfraud's example and burn the entire equity. "Never mind all the judges and laws that say I'm wrong, never mind the solicitors who advised me to settle. Never mind the neighbours, or my reputation and career as a teacher. Some people on the internet are applauding me, urging me to fight to the end. I'm their hero now, a common law civil rights leader. I've never felt so special and important, I'll sacrifice anything to keep this warm self-righteous glow for as long as possible."exiledscouser wrote:This isn't going to go away and I expect the property will be secured with a bit more than some old plywood next time.
