My favorite part of the whole transcript, was after having the judge agree that she can waive her rights to a lawyer, she makes a statement to the effect that she wants it on record that she is waiving none of her rights.

As all her rights include the right to a lawyer, the judge calls back the lawyer who was representing her to continue as she had stated unequivocally on the record that she was waiving no rights.

Then their proceeds to be a drawn out discussion between the lawyer and the judge about her intentions not to waive the right to counsel. This is the best part.
I know that's what she said, but she didn't mean it, allow get another chance, for which the judge correctly shoots down each time, and then repetitive objections throughout the rest of the hearing.

I was dying, it was like a Monty Python sketch. Worth a read if you haven't, if just for that whole exchange, once she takes control, for a brief moment. Her questioning by the judge would be a good place to start to set the scene, and see how she succeed only to snatch defeat from the jaws of victory.

Why can't Heather say what she means? Why can't Heather just say "I foreclosed on the United States give years ago via unrebutted affidavit, so none of you have any authority"? That's what she means. It's what she believes. She says the second half of it, but hides the truth behind nunc pro tunc Pretoria whatever, and a document dump. Then takes this "duh" attitude with the lawyer and judge, as if that makes perfect sense, and we should all know to hand over the keys to the federal reserve and the nuclear launch codes.

I know scammers have to act like this, but it's troubling that it fools so many.

Ah, where to start. The guy at USAA retired, it had been announced he was going to in April.

The crack(head) legal team is also fixated on the spelling of the FBI agent's name being different in two transcripts and what the letters USAA stand for.

Well i just had to go to USAA's website to pay my car insurance. And guess what, it still stands for "United Services Automobile Association". And i couldn't find any big financial scandal, just one instance of a suit over a claim, some news about corporate affairs, and one story about someone who had to complain to get his rental coverage.

I liked the way the judge turned the standard pseudo-legal 'all rights reserved' back on her by accepting the magic phrase at face value.
It has to be said that Mr. Bos was faced with the most unsuitable clay to make bricks from, just sloppy mud really, and of course, no straw.
He did give it a try of course, I think the most difficult part about lawyer training must be where they teach them how to keep on talking when they know they'd have as much luck just performing a few card tricks for the court.

This will grind politely and meticulously on through multiple hearings and days and days pf court time until the actual cost to the government of the prosecution and detention far exceeds the amount of the attempted theft, so I propose a novel tenet. If it costs more to prosecute someone than they have actually stolen, just forget about it.
It is arguable that prosecutions have no deterrent or exemplary effect anyway, as felons are all convinced that they themselves will not be caught, so let's get the economics right.
With all the money saved on prosecutions, the Federal Budget could be balanced, and if anyone is really bothered about some specific case, I propose sponsored prosecutions where the aggrieved party, or anyone else for that matter can pay to get a specific alleged felon incarcerated.
After all, companies sponsor sporting events, etc. so what's wrong with 'This trial brought to you by Heinz Baked Beans, the felon's favourite', or there could be collectively funded trials using crowd sourcing so if enough people want someone strung up, they could all pay for it.

This may all be a bit too advanced for today, but the time may come. :-)

Not that I agree with the idea anyway, but in total Randy and Heather did try to steal $29 million and got at least $1.5 million out the door.

That would create a field day for every felon out there to not only commit crimes for gain, but then to jam the system up with pointless contentions and paperwork in order to get the resulting trial cancelled. The real cure to the frivolous filings and arguments made by sovruns and the like is to simply cut off their crap when it first pops up, label it as frivolous, and roundfile it. If they want to appeal such rulings, they can, but the appeal courts should be alert for the crap that it is and quickly dismiss the appeal.

Of course, my favorite anti-constitutional solution is to simply take the sovruns who are bleating nonsense and rule that they are correct, that they are not under the law as they claim and they will be released into an environment where there will be no laws to oppress them. They are then taken from the courtroom, put on a cargo plane and forcibly parachuted into Somalia.

If this were the rule of thumb few of the Poriskyite tax evaders would have been prosecuted. Michael Millar, one of the leaders and motivators of the scheme, only evaded about $25,000 in tax. Tax evaders are prosecuted for deterrence, not because of some financial balancing act by the government. Not going after them would send the signal that it's allowable to evade tax as long as you don't get too greedy about it.

The HATJ fan club are all over You Tube with as much misinformation about this great modern martyr as you'd need to fill at least two political campaigns. They really do not have much to work on except facts, which makes it a bit tricky, but undaunted Neil Wolf "activist and independent researcher" spins whatever he can find.

Let's stop him at 3 minutes in. He says Randall accessed an account with his name and SSN as account number. In fact, no name is involved, and the account number was a coincidence. The electronic bank clearing system does not need names, that is why this scheme, which is essentially trying to dip into bank accounts at random, may appear to work at first. It is still a plain and simple fraud attempt.

Go to 5 minutes in and he puffs HATJ without mentioning that for the last 5 years or more she has been promoting nonsense get rich quick scemes on the internnet and moved to Morocco to avoid US prosecution. She returned recently to the US, and promoted the bank routing number fraud, and was arrested.

NO-ONE has any secret account in their name. Urban Myth.

I can't really be bothered with the rest of it, it is standard nonsense about admiralty law and strawmen, etc.

The scheme isn't even hitting accounts at random, or doesn't need to. The place where you enter your information, at best, only needs the ADA routing number to match a known bank (and a lot of them only needed it to have the right number of digits for that, some of which have hurriedly updated that level of security). The account number fields are not matched to anything beyond a minimum and maximum number of digits (6-24 is the maximum the Fed is formatted for but most banks use 16 digits or less) so as long as you enter 9 digits for the ADA and 6-16 digits for account number, it MIGHT work, if you enter 9 digits of a known actual bank that is not restricted (a list that is going up right now because of this) it WILL work, until the periodic batch file uploads to clear at the destination banks, a process the merchant has 2 business days to complete. That's when it becomes random, and if you do happen to hit a valid account here, you might even get away with it forever with a customer not paying attention to their bank statements. If they are, it might be 30 days before see it and 60 before they report it and another 10 for it to be reversed, so you're not even MAYBE in the clear until a transaction is 70-75 days old.

One of Randall's dumber moves was doing all the stuff after stealing it from the Federal Reserve Bank all inside one bank, USAA, even paying off his USAA credit cards with it. Made the paper trail much cleaner and easier to explain the the Grand Jury. Money laundering for Dummies.

Neil Wolfe is on my short list for the Anti-Nobel Prize for stupid this year. He isn't Tom Crawford Stupid, he's Amanda Pike after a concussion Stupid. First he thought she was going to be let go because she was on the release list of the DC Jail. Like, release to another jail, but that was beyond him. Then, after she didn't show up on Constitution Ave by the end of the day, he found surmised somehow that she was north west of Washington so that meant Camp David, even though she wasn't in the direction he thought she was, and neither was Camp David for that matter. Now, he thinks she's something, something but the fact that she went to Oklahoma and then Georgia is a significant part of it..because, reasons. SHe should have gone straight from DC to Knoxville, and it should have been a first class seat on a non-stop flight, because she's going to be released with an apology when she gets there anyhow.

I can't go on. How far into her 5 year sentence (official Quatloos Sentence Casino odds) are these fools going to follow this storyline, how many of them are going to go join her and Randy in prison?

Only time will tell, although experience indicates possibly six months depending on how fast appeals can be rejected. However, for an old man with nothing much to do, following the strange tales of odd people is just that much more interesting than TV soap operas.

I agree, even for an OPPT'er Wolfe can only, vainly, aspire to eventually rising to being the dullest knife in the drawer.

Observation is that the OPPT crowd have incredibly short attention spans to go with their even shorter long term memory. Since the wheels have so quickly fallen off and it has so thoroughly fallen apart I don't expect it to last too much longer. I would expect Heather has an actual arraignment coming fairly soon, although that may just be a stop gap, I would bet the Grand Jury is still out on what all they will ultimately charge her with. I suspect they have a pretty complete list for Randy, but they may hold off a while on Heather to see how much time they can ultimately get for her. They will have her on the conspiracy or whatever they are calling it to aid Randy and that I think is a certainty. I would think there could be more to come. If things run true to course, actual trial could be as much as a year out. Heather's junkies don't have that much patience or attention span.

Heather is preparing to dissolve the prison system. In general she talks a fair bit but I can't really get any sense from it. Today is the day, it seems (21.8.2017) Heather is amplifying BEing and DOing.

This is a compilation of several calls from Jail. She says she is meeting lots of fans in jail, some who have been there for years. She is apparently having a real fine time.
I don't know how CERN (European Center for Nuclear Research) but it seems it has been opressing her since 1971 or 72.
Little throwback to traditional witch craft pops up. It seems DNA samples are manipulated to control people, a modern take on the hair, fingernails and bodily fluids used to personalise voodoo dolls.
She seems to have met a few sov-cit types.
It is all going to be a bit of a let down tomorrow when nothing detectable happens.
