Dentist Charged With Tax Evasion

LAKELAND - A Lakeland dentist was indicted Monday on federal charges accusing her of evading income taxes and not filing tax returns in a case that prosecutors said involves millions of dollars in unreported income.

Dr. Nancy Montgomery-Ware, 43, who specializes in pediatric dentistry, was arrested about 9 a.m. Monday as she arrived for work at her office at 225 Imperial Blvd. in Lakeland, said Steve Cole, spokesman for the U.S. Attorney's Office in Tampa.

The U.S. Attorney's Office said Montgomery-Ware evaded paying taxes on more than $1 million in income in 2000 and 2001, and didn't file federal income tax returns in 2002, 2003 and 2004, when the total gross income at her thriving practice exceeded $2 million.

She is charged with two counts of tax evasion and three counts of failure to file income tax returns, according to the indictment handed up by a federal grand jury in Tampa.

If convicted on all counts she could face a sentence of 13 years in prison and an $800,000 fine, prosecutors said.

She was released on $100,000 bail Monday and is scheduled for an April 18 arraignment hearing in Tampa, Cole said.

Montgomery-Ware could not be reached for comment Monday.

A sign posted on the door of her office on Lakeland's south side and an office answering machine message said she had canceled appointments because of a family emergency and appointments will be rescheduled.

Prosecutors contend Montgomery-Ware used various tactics to disguise her income.

She evaded taxes by filing fraudulent W-4 forms, claiming to be exempt from federal income tax withholding, the U.S. Attorney's Office said.

Montgomery-Ware used cash in many cases, making it hard to trace her transactions, and put money in different bank accounts to "conceal the nature and extent of her income", the office said. And she filed a "frivolous lawsuit" as a tactic to avoid paying taxes.

Montgomery-Ware is one of only a few Polk County pediatric dental specialists.

She received her dentistry license in 1990, according to the Florida Department of Health. Her license will expire in February 2008, according to the department's Web site.

She has no record of any disciplinary actions taken against her, according to the Web site.

As far as her "guru", it might have been Walter Anderson, by which I mean she didn't have any paytriotic theory, but was just a crook that didn't want to pay.

She will probably develop a theory now about why she is right and the government is evil, but that's different.

It's a little eery how similar this case is to Ed and Elaine Brown. The Browns built their entire McMansion without a single building permit.

The County satisfies the third prong--that it had a clear legal right to relief--because Mr. Ware continued building and using the Quonset-type structure, aware that he was in violation of code section 110. See P.M. Realty, 779 So. 2d at 406 ("[W]here one opens a business aware of the violations to the ordinances and continues to operate that business in violation, the government has a clear legal right to relief."). Mr. Ware was repeatedly advised over the course of three months that he was in violation of code section 110. The County's field code investigators notified him of the violation and the Code Enforcement Board hearing officer gave him additional time to correct his violation. Nevertheless, Mr. Ware continued to violate the county ordinance because of his basic lack of understanding of building permits. At the evidentiary hearing, Mr. Ware admitted to building without a permit but testified that as a "free, white" person who had purchased the property by tax deed, he was allowed to build a "barn" on his property without a permit from the County. Despite explanations to Mr. Ware that he was not exempt from permit requirements simply because his tax deed said that the land was free from any encumbrances, he obstinately refused to listen. The County had a clear legal right to relief because Mr. Ware was aware of his violation of code section 110 and continued to violate it.

Okay, they're loonies all right.

And although Nancy Montgomery-Ware kept suing Dr. Bopp, her employer was actually Bopp and Montgomery, P.A., so it looks like Bopp and Montgomery-Ware were business partners. I wonder how long that lasted.

Another similarity with the Browns is that Montgomery-Ware probably started her practice with Bopp before she married Paul Ware, which means that in both cases the husband is the infecting agent and the wife is the one who actually earned the income and will go to prison.

Finally, getting back to the issue of the guru, it's still possible that these are undomesticated, free-range loonies, without a guru.

Dentists seem to have a proclivity for being sucked into this type of nonsense, either directly, or theough an idiot spouse.

Sadly, my own dentist was sucked into the same pure-trust scam, as perpetrated by National Trust Services, that I was.

As far as I know, he's still using the "system of trusts" they set up, despite my reasoned urgings against it.

Intelligent, well-educated, highly successful professionals don't just start defying the law for no reason, because they have too much to lose.

There had to be some catalyst. Tax denying new husband/boyfriend? Previous infuriating dispute with the IRS?

I must admit, I'm very curious why she took the same leap taken by Elaine Brown.
