Judge: Women must stop 'paper terrorism'
A local magistrate and a Dauphin County judge said false allegations were made.

WILKES-BARRE - Two Scranton women who were upset with rulings made by a local magistrate and a Dauphin County Court judge utilized the Luzerne County Recorder of Deeds office to effectuate a form of "paper terrorism" against the judges, the jurists say in a complaint.

District Judge Fred Pierantoni of Pittston and Dauphin County Judge Lawrence Clark were forced to take the court action after Claudia Ann Montelione and her daughter Francesca Montelione used the deeds office to improperly file a civil action against the judges, the complaint says.

The unusual case stems from a document Francesca Montelione filed with the deeds office on behalf of her mother on June 10.

The rambling, 10-page document titled "reservation of rights and constructive actual notice and demand," purports to make claims of improper legal rulings by Pierantoni and Clark. It is written in an extremely disjointed fashion, making the precise allegations difficult to understand.

The problem, Pierantoni and Clark say, is the document had no basis to be filed in the deeds office because it is not a mortgage, deed or any of the other types of documents the office accepts.

A clerk in the office did not immediately recognize that, however, and accepted it. Because of that Pierantoni and Clark had to go to file a motion seeking an order directing Recorder of Deeds James O'Brien to expunge the document from his records.

The motion, filed by attorney Geri Romanello St. Joseph, says Montelione filed the document in order to harm Pierantoni and Clark by making false allegations against them. St. Joseph said Montelione was upset because Clark held her in contempt of court for a matter in Dauphin County.
Pierantoni had ruled against Montelione regarding a traffic citation.
She notes Montelione is already facing charges of retaliation against a prosecutor.

"This 'paper terrorism' is commonly used by self-proclaimed sovereign citizens like the defendants . . . to intentionally cause harm to judicial officers," the motion states.

Luzerne County Judge Ann Lokuta granted the judges' motion in a Sept. 11 ruling that forbids the Monteliones from attempting to file similar documents with the deeds office.

O'Brien could not be reached for comment Friday. The solicitor for the office, Peter J. Moses, said O'Brien agreed the document was improperly filed and did not contest the judges' motion. He said they had to get a court order because the office could not simply remove the document from the docket.

Moses said he does not fault the clerk for accepting the document because office employees are directed that they are not to make legal determinations.

"These women tried to deceptively file documents," Moses said. "The fact is that out of the thousands of documents we file every year, one document was filed in the office that shouldn't have been."
