This strategy scraps all the misconceived reliance of the IRC and bases itself solidly in origination. Yeah, I have been able to get the IRS to waive some pretty good sized penalties, but they were on "failure to timely file", "failure to timely pay" -- that sort of thing. I have never had a client with section 6702 ("frivolous") penalties, and I don't recall ever trying to get such a high amount ($110,000) waived.
