Ok, i'm going to get serious for a moment. After this i'll not only ignore ng, i'll ignore all discussions involving them.


So here goes:

AUTHORITY COMES FROM CONSENSUS

The Declaration refers to "consent of the governed", but it's not the kind of consent you've been nattering about. The phrase "the governed" refers to the population as a whole, and "consent" refers to the lack of serious opposition by the population. Which is another way of referring to consensus. It's not your "I, as an individual, give you my consent, so you're allowed to govern me". It's "we, as a whole, either approve of this arrangement, or at least acquiesce". There's your "silence gives consent", btw, "acquiesce" means "be quiet".

So in short: Consensus = Approval + Acquiescence. One of the entries in your questionnaire is "majority rule". Historically consensus has rarely been a matter of absolute numbers. It's been a matter of weighted numbers. You also refer to force and threats, that's one way of weighting. "We don't like the king, but we don't like even more having knights burn our homes and stab us; guess we'll put up with him." You mention tradition, that gives rise to social and cultural pressures. Which are another form of weight. "Listen, children, Jesus gives us our kings and bitching about any of them makes Jesus sad." Then there's human nature. "Revolution? Sounds great, but, um, i don't think i can afford to leave my farm just now." And skepticism. "Ok, i can see dying for freedom, i just don't see that this revolution is really about that."

As civilization has progressed we have moved in the direction of consensus reflecting the opinions of a true majority, albeit there's plenty of room for improvement. We've also developed the concept of rights, which are sort of derived from a long term consensus to restrain the effects of a transitory one.

And once a consensus is established, it is binding on every member of the community, including you. And our current consensus has left no room for anyone to willy nilly opt out. What it does allow for, is for itself to be changed through persuasion. Not by sending notices of personal secession, nor by arguing semantics with judges. You have to campaign. You have to offer argument. You have to offer reason to think that change will be worthwhile. Not just the hearty approval of your fellow believers, but the visible acquiescence of a whole lot of people who currently find the status quo to be at least the lesser evil.

If you are so ignorant of the law to think that, because the decision of an appellate court is an "opinion", that it's just the justices' guess as to what the law is, rather than a definitive statement of what the law is, you're hopeless.
