Having tried cases with pro se's, as judge and counsel, I really think the answer is politeness but firmness.

Politeness because it makes the system look better and lets the TP go away with a better taste in his or her mouth. And, because polite explanations may leave the pro se feeling as if he was part of the process and not excluded.

Firmness, because the court only has so much time. A firm hand on the tiller lets the case slide along fairly quickly. (Otherwise, the judge will get irritated, or the other counsel, and the whole politeness posture vanishes, leaving the pro se feeling he has been railroaded and not understanding what has happened.

(One night, in Austin, a pro se was trying to recover damages under a rental agreement from a debtor who had rented the pro se's house. I lost it when he started in on the "patriot card," asserting that he was a veteran, etc. Barked at him and told him I could wrap myself in the flag as easily as he could. He stayed on the straight path thereafter, and actually recovered some of his damages.)

For my practice it's pretty simple. First, I don't "do" litigation. So it is in the interest of both me and my clients to try to settle the matter before going to court. If it does go to court I hand off to a litigation specialist. Second, life is way too short to represent clients that don't take my advice. And seeing my advice to any tax protester is to wake up and smell the coffee, I doubt many tax protesters would want me to represent them.

You know, occasionally I will see them represented....by their criminal attorneys who are "just trying to tie up loose ends."

Somehow everyone has interpreted the "community of over 2 million people" as a city or hometown. I took it as a virtual "community." Of course, there aren't 2 million tax deniers, either, but that's probably what the poster meant.

Hey all, I'm new to Quatloos. Doc Avalanche recruited me from Youtube. On the subject of your post, in reading some of the decisions on Dan Evan's website I saw several instances of Judges doing exactly what you said, being very lenient with pro se tp's with their court filings as well as fines for frivilous motions.
