According to my Plum novels and this Bail Bond FAQ, that's their fee for taking the chance and putting out $100k for you. Non-refundable.Demosthenes wrote:Sherry was already sentenced to the maximum possible sentence of four years.
I have a stupid question. If you give money to a bond company -- say $10,000 for a $100,000 bond) do you get it back at the end of the bond period when you turn yourself in, or is that money simply gone, kind of like an insurance premium.

So all Sherry would be buying is a 30 day delay in the start of her sentence in exchange for $15,000. Ouch.

Re: Sherry Peel Jackson Makes a Bad Situation Much Worse
That's not a stupid question, I think a lot of people wonder about that. Money paid to a bondsman is gone. That bothers me, though, because innocent defendants are essentially paying a fine to a third party, for a crime they did not commit. There should therefore be a better system, in my opinion.Demosthenes wrote:Sherry was already sentenced to the maximum possible sentence of four years.

So Sherry got the max, eh?

Sherry's post conviction filings and threats to not appear in court pissed off the judge. He granted the government's motion for upward departure:

So where is the proof that he granted the upward departure? The link is just the memorandum in support of their motion for an upward departure. Did the judge actually grant it?

Considering that she's proceeding Pro Se (or "sui juris" as the TP crowd like to say), her "Godly counsel" probably refers to the voices in her own head.UGA Lawdog wrote:"Godly counsel"? Don't tell me she's been talking to Togadude.

You have to get Jesus to testify (to overcome any hearsay objection) and then it will work.tracer wrote: Last I heard, though, "Jesus says I'm not guilty!" doesn't work as a legal defense.

Re: Sherry Peel Jackson Makes a Bad Situation Much Worse
It seems that the outstanding action (incarceration order) pending against the accused (somehow, she overlooked the conviction) should be overturned or stayed because 26USC7203 is ambiguous or, in the alternative, because the government failed to prove that she, an experienced IRS agent, was aware of 26USC7203.

Any person required under this title to pay any estimated tax or tax, or required by this title or by regulations made under authority thereof to make a return, keep any records, or supply any information, who willfully fails to pay such estimated tax or tax, make such return, keep such records, or supply such information, at the time or times required by law or regulations, shall, in addition to other penalties provided by law, be guilty of a misdemeanor and, upon conviction thereof, shall be fined not more than $25,000 ($100,000 in the case of a corporation), or imprisoned not more than 1 year, or both, together with the costs of prosecution.
In the case of any person with respect to whom there is a failure to pay any estimated tax, this section shall not apply to such person with respect to such failure if there is no addition

In the case of a willful violation of any provision of section 6050I, the first sentence of this section shall be applied by substituting "felony" for "misdemeanor" and "5 years" for "1 year".
